Thank you for your request for information held by the Council under the
provisions of the Freedom of Information Act 2000 which was received on
28/10/2016

 

This has been referred to the relevant service area to identify, locate
and retrieve the information that we hold. 

 

I would point out that under the Freedom of Information and Data
Protection Act (Appropriate Limits and Fees) Regulations 2004, a local
authority, such as Birmingham City Council, is obliged to respond to
requests for information where the request or related requests can be
complied with within 18 hours of officer time.

 

If we consider it would take over 18 hours to handle your request we will
let you know.  In some cases it may be that the information could be
provided if a fee is paid for the work to be undertaken. We would then
issue a fees notice which would need to be paid before the request was
handled.   For other requests, it may be possible to offer guidance as to
how the request might be re-scoped to enable information to be provided
within the 18 hours appropriate limit.

There may be a problem with the wording of the request. As far as I know, it's the "Great Run Company" and the "Great Run Local Foundation".

Dear Birmingham City Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Birmingham City Council's handling of my FOI request 'Payment for the provision of Great Run Local'.

This request was submitted on the 28/10/2016, with a response on 31/10/2016 stating that the request had been passed to the relevant service area.

The next response from BCC was on 28/11/2016, which is a full 20 working days after the first response.

This response was
"it has become necessary to consider applying the public interest test...
In order to carry out this legal work, the Freedom of Information Act allows Birmingham City Council, as a public authority, a further reasonable amount of time. This request has therefore been passed to our legal team to apply a public interest test to this request.
Birmingham City Council will endeavour to forward a response in relation to the information sought subject to the public interest test by no later than 23rd December 2016 (40 working days from original request date). However, it may be that due to additional circumstances, this limit may need to be extended. If this is the case, you will be notified before the above date, with the reasons for the delay. "

To date, there has been no further response from BCC.
There has been an additional 10 working days since 23/12/2016.

I would like the internal review to look at;
Why did it take the full 20 days before the response of 28/11/2016 was sent?
If there are "additional circumstances", what are they, why was no notification of this delay sent prior to 23/12/2016, & is the extended time limit reasonable.
If there are no "additional circumstances", what is the outcome of the public interest test, & why has the outcome not been provided by 23/12/2016.

The Information Commissioner’s Office recommends that public authorities carry out internal reviews within 20 working days.
