Thank you for your email of 2 June 2021.

 

This will not be treated as a Freedom of Information request as it does
not ask for specific pieces of information but for general information
which the Council would routinely release as part of their day to day
operation.  It is, therefore, considered to be a “Business as Usual”
request.

 

The Transport (Scotland) Act 2019 has been given Royal Assent and has
passed into law, however, secondary legislation in the form of a
Ministerial Direction is required before the footway parking ban can be
enforced. 

 

The purpose of the Direction is to specify the assessments that are
required to be carried out in connection with making exemption orders, and
also the road characteristics that will be required to be met prior to
making an exemption order under the Act.  Transport Scotland are working
on both this and the Parking Standards Guidance which will be used by
local authorities when undertaking the assessments.

 

Both the Direction and the Guidance will be widely consulted on and
Transport Scotland anticipate that this will be concluded by Autumn 2021. 

 

After that local authorities will be required to undertake assessments of
their networks before making an exemption order for those locations to be
excluded from the ban. 

 

Transport Scotland and COSLA are currently considering the provision of
funding to be allocated to local authorities this financial year 2021/22
to undertake these assessments.  This funding will allow preliminary
assessment work to be undertaken once the Guidance is available towards
the end of 2021. 

 

We are presently considering how best this assessment work can be
undertaken and the priority areas.  Given the dynamics associated with
Covid19 (i.e. greater number of residents parking at home) this will
require to be treated sensitively.  Given the scale of the exercise this
is also likely to require consultant support and be completed over a
phased basis.

 

Taking all of this into consideration it is anticipated that local
authorities will be in a position to enforce the ban late spring / early
summer 2022.

 

In the meantime, if you consider that a vehicle is parked so as to cause
an obstruction or a danger to other road users, including pedestrians,
Police Scotland have the necessary powers to deal with such situations.
