FOI inquiry re independent ambulance service provision into SHSCT

Regarding the provision of patient transfer services for SHSCT from April 2017 to date:

1. Please name the independent ambulance service providers used to provide patient transfers into/from:
• Daisy Hill Hospital
• Craigavon Area Hospital

2. For each service provider, please clarify on what contractual basis those services are provided.

3. For each service provider, please specify the number of patient transfers carried out per month in that period and the corresponding amount(s) paid by the Trust.

4. EU procurement regulations stipulate that public sector procurement must provide:

• Transparency - contract procedures must be transparent and contract opportunities should generally be publicised
• Equal treatment and non-discrimination - potential suppliers must be treated equally
• Proportionality - procurement procedures and decisions must be proportionate

Please specify the procurement records / references demonstrating adherence to these legal requirements e.g. ITT/RFQ reference, date and details of how they were circulated to potential suppliers.

Given that the Freedom of Information Act 2000 specifies a public interest test for information disclosure, I thought it would be helpful for your evaluation to note that it is clearly in the public interest to demonstrate that procurement and contract management have been carried out in a transparent manner, with equal treatment for potential suppliers and non-discrimination against any potential supplier.

The Trust has reported that they do not hold this information and have advised me to contact NIAS.

I am somewhat sceptical but will raise an FOI with NIAS.

The NIAS request was not responded to in time, so I escalated to ICO.

After further delays by NIAS, the ICO resorted to serving NIAS with a Decision Notice which threatened NIAS with Contempt of Court.

At this point, NIAS responded to the enquiry and provided the requested statistics.
