Past papers for the Kent Test

We're waiting for Mike Thompson to read recent responses and update the status.

Dear Kent County Council,

I would like to be sent digital copies of all the past papers for the Kent Test for the last three academic years, along with a key, where relevant, showing the correct answer for each question.

I think that making these papers available is very much in the public interest. They could be a valuable resource for children and parents preparing for the test, and particularly for less privileged students who may not have the resources to pay either for tuition or for additional preparatory material beyond what is currently made available by commercial providers.

Please do feel free to contact me if you have any questions about this request or there are any easily resolvable issues with it that might lead to a refusal.

Dear Kent County Council,

I’m writing to request an internal review of the response to this FOI request. Please pass this on to the person who conducts FOI reviews.

I understand the logic to your response, but I disagree that it is acceptable under the FOI act: if you are to refuse a request, you must state which exemption it is being refused under and why that exemption applies.

It appears that you are refusing the request on grounds of copyright. However, the ICO makes clear in its guidance on this topic that this is not sufficient grounds for rejection of a request. Please see section 13 on page 6 of this document: https://ico.org.uk/media/for-organisatio....

Please also bear in mind section 47, page 16 of that document: sending a reply to a request made via WhatDoTheyKnow.com which will then be automatically published is not sufficient grounds for refusing a request either.

As to your other point about a secure bank of questions maintained by the provider, this sounds to me like a convenient mechanism for them that removes the need to regularly draft new questions which helps keep their costs down; but it is surely not the responsibility of a local authority to help a private company manage its costs.

On your final point, the problem-solving tests you refer to have been shown by independent research [1] to be loaded against poorer pupils. The research identifies a lack of preparation as being a key factor. If more information on the kinds of questions was available publicly, it would be easier for pupils and parents without access to tuition to prepare for the exam.

If it helps, I am happy to reduce my request to only the reasoning papers and their associated answer booklets for the last three academic years.
