Dear Department for Work and Pensions,

Private Companies like Calder UK, Ingeus and A4e are asking your
Flexible New Deal customers to provide copies of their Passport,
Birth certificate, Bank Statements, Utility bills and or Driving
license, can you advise on what exact legal basis, quoting
legislation or regulations, they are doing this and if your
customers do not consent to provide any one or all of these items
they will not lose any entitlement to benefits. Please provide a
copy of any guidance provided to these Private Companies on these
issues and or your own internal guidance, covering Flexible New
Deal and the newer Work Programme.

Dear Steve Palmer,

Thank you for your Freedom of Information request of the 25 May 2011in
which you ask:

The Department requires all providers to verify the identity of each
claimant referred to them to ensure that the person they are
communicating with is in fact the claimant. This is to avoid fraud and
to ensure compliance with the Data Protection Act 1998. The requirement
to do this is outlined within the programme specific sections of the
Provider Guidance. Although the guidance states that providers must
check the identity of each claimant, how they do so is at the provider's
discretion. The Provider Guidance is available on the Department's

Claimants referred to DWP employment programmes are required to provide
identification information as part of their participation in the
Employment, Skills and Enterprise scheme. If the claimant does not
participate in the Scheme their benefits may be affected - see
Regulation 4 of the Jobseeker's Allowance (Employment, Skills and
Enterprise Scheme) Regulations 2011. This is available on the National
Archives website via www.legislation.gov.uk/JSA Regulations 2011

Flexible New Deal and the Work Programme are compulsory employment
programmes. While participating in these programmes claimants have the
following responsibilities:

* make the most of the help given by the provider
* attend meetings or take phone calls at the times agreed
* complete any activities agreed with the provider
* continue to actively look for work
* attend the Jobcentre every two weeks, and
* tell Jobcentre Plus about any changes in their circumstances.

If a claimant does not take part in the programme without a good reason,
their benefits may be affected - Section 19 of the Jobseekers Act 1995
(www.legislation.gov.uk/JSA Act/1995), and Part V of the Jobseeker's
Allowance Regulations 1996 (www.legislation.gov.uk/JSA Regulations
1996).

Dear Department for Work and Pensions,

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of Department for Work
and Pensions's handling of my FOI request 'Passport, Birth
certificate, Bank Statements, Utility bills and or Driving
license'.

Can you advise how Flexible New Deal Welfare to Work Programme
Providers, comply with the European Convention on Human Rights
article 8 on these matters of Identity checks.

Please advise how provision of a Passport, Birth Certificate,
Driving License, Utility Bills is compatible with the DWP's own
Provider guidance:

"New Deal Guidance – Section 03 – The Initial Meeting Customer
Action Plan and Fortnightly Contact

Identity checks

3.14. It is important that in any communications with customers you
verify the
customer’s identity, which could include asking them to state
their:

• full name;
• address; and,
• National insurance number.

3.15. You may also decide to request further information such as
details that were
included within the original referral from JCP such as:

• a customers preferred employment goals; or,
• details of a customers previous 2 periods of employment."

I do not see any reference to the Data Protection Act, Human Rights
legislation or a 'Passport, Birth certificate, Bank Statements,
Utility bills and or Driving license'.

Please provide copies of Internal Guidance that shows that
provision of a 'Passport, Birth certificate, Bank Statements,
Utility bills and or Driving license' in done on the basis of
"informed consent" and that refusal to consent to providing a
'Passport, Birth certificate, Bank Statements, Utility bills and or
Driving license', which the DWP already holds is necessary or
lawful.

Please provide copies of the internal guidance or guidance that
gives Providers lawful authority in there own right to ask members
of the Public to provide evidence of Identity as a 'Passport, Birth
certificate, Bank Statements, Utility bills and or Driving license'
and that they have given "informed consent" to share such with
third parties including the DWP?

The Data Controller for Work Programme services is the DWP, please
provide internal guidance that confirms that user of Work Programme
services can provide Jobcentre Plus with proof of Identity and
therefore does not need to show them again to your often Private
Company Providers, as these providers are merely acting on behalf
of the DWP.
