Passing off

The request was partially successful.

Dear HM Courts and Tribunals Service,
Under the freedom of information act i require the information relating to the
Records HMCTS holds relating to Council tax

1 Does HMCTS Hold a record Libra or otherwise of the liability hearing for
Council Tax and how far back is HMCTS required to hold said record / Data
.(if the record exists.)

2 Does HMCTS Hold a Record/Data of the sworn statement of Complaint
Made by the council officer and how far back is HMCTS required to hold
said record.(if the record exists.)

3 How Can a Charge payer / Debtor or any third party such
as Enforcement Agents/ Agency etc Access this information from
HMCTS (if the record exists.)

4 What special Treatment is provided to Councils and utility Company’s via
Magistrates Courts/HMCTS.

5 Has Any Enforcement Agency Ever contacted HMCTS to Validate
Authenticate a Liability Order has been granted since 2003.

I.e would this Data be Available via subject access request to the Debtor
and how would third parties Acquire this information from HMCTS to
Validate and Authenticate any Orders or Judgments Made, just in case of
any Future litigation that May arise between the third party and debtor.

It has also been noted that Justices of the peace are being Directed either
by the claimant (council) Or the Court Manager to sign council liability
Orders witch is outside of any Judicial function since 2003 furthermore
Enforcement Agents are unable to provide any official Court
Documentation when Challenged, logic would also Dictate the use of the
J.Ps signature being present on Council Documents is a form of Coercion
i.e Giving the impression that Document has come from the Court when it
has not, and from my Experience the courts hold no Libra record the Moj
holds no record and Councils are “passing off” Documents as Official Court
Documents Due to the presence of the J.P’s signature i.e Uttering which is
Fraudulant and lets also not forget the overcharging via councils for Court
costs that HMCTS and MOJ holds no record of in the first place and this
has been happening since 2003, if im wrong then kindly correct me.

Yours faithfully,

michael john
