Part F Building Regulations Compliance

Dear Rochdale Metropolitan Borough Council

Please provide the following data regarding compliance with Part F of the Building Regulations for works overseen by your Building Control Body within the last 12 months:

1) total number of domestic properties for which building regulations approval was sought

2) the number of these which included installation of a mechanical ventilation system within the meaning of Part F

3) of this number, the number which
a) included the Commissioning Notice required in Part F section 4.42 "Air flow rate testing and commissioning of ventilation systems"
b) included a flow rate test

Dear Sirs

I acknowledge receipt of your request for information, which has been
processed under the Environmental Information Regulations (EIR) 2004.

Your request was as follows:

 

Please provide the following data regarding compliance with Part F of the
Building Regulations for works overseen by your Building Control Body
within the last 12 months:

1) total number of domestic properties for which building regulations
approval was sought
From January 2018 – December 2018, Rochdale Borough Council received 670
domestic related building regulation applications.
2) the number of these which included installation of a mechanical
ventilation system within the meaning of Part F
3) of this number, the number which
a) included the Commissioning Notice required in Part F section 4.42 'Air
flow rate testing and commissioning of ventilation systems'
b) included a flow rate test
We consider that points 2 & 3 of this request are excepted to the duty to
disclose environmental information and so the request is refused under EIR
2004 regulation 12 (1) and 12 (4)(b)

as being manifestly unreasonable as it would create an unreasonable burden
upon council resources.

At a conservative estimate, locating this information for each application
and then documenting the findings, would take a surveyor on average at
least 10 minutes per application - which amounts to 111 hours.

If you would like this information to be collated, then the authority has
the right to charge for the time expended on its provision under Reg 8.

The hourly rate for a surveyor is £50, so an advanced charge of £5550.00
would need to be paid prior to undertaking the work.

You are advised that we will hold the majority of the information
requested, although many of the relevant applications received during this
time period may not have commenced or may not have advanced to the stage
where

ventilation has been installed. The information requested would therefore
likely be incomplete.

As is required under the Act, you are advised that you may make
representations to Rochdale Borough Council under Reg 11

and are informed of the enforcement and appeal provisions of the Act in
Reg 18.
