Parks & Open Spaces Order 1971 Greater London Council

We're waiting for Rose Reynolds to read a recent response and update the status.

Dear Land Registry,

The London Authorities (Parks and Open Spaces) Order 1971 redistributed the ownership and management of certain parks and open spaces vested in the Greater London Council between local authorities in and near Greater London. These parks and open spaces carried restrictions as 'Parks & Open Space when transferred. This was a Statutory Instrument. Please can you provide details of which parcels of land still have this restriction? Secondly the dates of if and when the restrictions were removed?

details of which parcels of land still have Parks & Open Space
restrictions and the dates of if and when the restrictions were removed.

 

Your request was dealt with under the terms of the Freedom of Information
Act 2000. Following a search of our records, I can reply as follows:

No parcels of land currently have a Parks & Open Space restriction on the
register.

 

Land registered as Calders Wharf and land to the East of Ferry Street had
a Parks & Open Space restriction on the register, this was removed on 23
April 2018.  

 

No other parcels of land have had a Parks & Open Space restriction
removed.

 

The data provided has been collected from a variety of sources as part of
the land registration process. Whilst we make every effort to ensure that
the data we provide is as accurate as possible we cannot guarantee it is
fit for your intended purpose or use.

 

The data is also subject to Crown copyright. You may use the data for
personal use/research but this does not entitle you to reuse it for any
other purpose (including commercial use, marketing or publication). If you

information about the removal of a restriction from land registered as
Calders Wharf and land to the East of Ferry Street.  

 

Part of your request was dealt with under the terms of the Freedom of
Information Act 2000. The remaining part was dealt with as part of our
normal business. 

 

The following parts have been dealt with under the Freedom of Information
Act 2000. 

 

 

1.     Please provide all correspondence relating to it being removed? 

 

Under section 21 of the Freedom of Information Act 2000 (the Act), we are
not required to provide information in response to a request if it is
already reasonably accessible to you.  

 

The information you have requested is available to you under our statutory
protocol under section 66 of the Land Registration Act 2002 and the Land
Registration Rules 2003.  

 

S21(2)(b) of the Act states that information is reasonably accessible if
“it is information which the public authority or any other person is
obliged by or under any enactment to communicate (otherwise than by making
the information available for inspection) to members of the public on
request, whether free of charge or on payment.” 

 

This means that section 21(2)(b) of the Act applies to your request.

2.     Who requested removal 

 

There was no external application to remove the restriction. It was
removed by HM Land Registry in accordance with our practice because it was
obsolete. 

 

 

The following part has been dealt with as part of our normal business. 

 

 

 3. Also please confirm that actions to Land Register Titles as can only
occur when there is a legal request to do so. 

 

HM Land Registry does not have to wait for an application to cancel a
restriction (or any other entry which no longer serves a purpose).
Schedule 4, Paragraph 5, to the Land Registration Act 2002 allows the
Registrar to bring registers up to date and to remove superfluous
entries: 

 

"5 The registrar may alter the register for the purpose of- 

 

(a) correcting a mistake, 

 

(b) bringing the register up to date, 

 

(c) giving effect to any estate, right or interest excepted from the
effect of registration, or 

 

(d) removing a superfluous entry".
