Parking space numbers in Arun's Hothamton "Linear Park" proposals

Dear Arun District Council,

Referring to Arun's Hothamton "Linear Park" proposals, Cllr Phil Hitchins, Chairman of the Bognor Regis Regeneration Sub-Committee has stated in writing on behalf of Arun District Council that "the number of parking spaces still remains at 199 having taken into account fire access to Fitzleet House." This is in spite of the Committee's report to Full Council for the meeting of 10th January 2018 showing the number of spaces counting as 178 on the recommended Option 2. If the Fitzleet House fire access were retained this would reduce the 178 to approximately 158.

As this appears to defy logic and as Cllr Hitchins clearly has information not currently being supplied to Council or public, can you please supply me with the fully dimensioned drawings upon which Cllr Hitchins has based his remarks, and any other necessary information so that I may have full understanding of his numbers and how he has arrived at them. Please do not try to tell me that his "199" is only "a concept". This is a specifically quoted figure and therefore must have some form of factual basis.

I am not asking for details of finances of any kind, nor any information of a confidential or commercially competitive nature, so you may feel free to redact anything that might prevent you supplying this information to me.

Please supply this information as soon as possible. There should be no reason for delay as Cllr Hitchins clearly has all this information to hand already. Please supply this information via this website.

RESPONSE:

 

The proposals prepared by the landscape consultants are concepts designs.

 

The display boards prepared for the public consultation illustrated how
the space can be used in different ways to accommodate a varying number of
car parking spaces within the context of also providing a new park. 

 

Members wish to see the maximum number of parking spaces retained and, by
adjusting the amount of landscaping and pathways proposed in the
consultation documents, 199 parking bays can be provided, 23 of these are
proposed to be oversize/accessible bays and 15 designated disabled parking
bays.

 

The next stage of the work will undertake the necessary surveys and
investigations into the site and identify any constraints.  At this early
stage in the design process, the Council is able to be flexible and make
adjustments to ensure parking bay numbers are maintained.

 

 

If you are dissatisfied with the way your request for information has been
handled, you can write asking for a review of the Council’s response,
within the next two months, to the Information Management Team at: Arun

Please pass this on to the person who conducts Freedom of Information reviews.

I am very dissatisfied with the way you have handled my FOI request 'Parking space numbers in Arun's Hothamton "Linear Park" proposals', and I require an internal review. If this is not dealt with satisfactorily I shall go to the ICO.

You have not made any attempt to fulfil my request as asked, and have ignored my instruction NOT to try and tell me that the proposal is only a "concept".

Cllr Hitchins has written on behalf of Arun District Council that "the number of parking spaces REMAINS at 199." (my capitals). See my original request for his full quote. He did NOT say "will be 199 when further investigations have taken place" or anything similar, or that "members wish to see..." (as you put it).

He has also said, in Full Council on 10th January "we have plans for 199 spaces", and in the same meeting and referring to the Linear Park "there is an increase in green space."

He has made all these very specific assertions which do not refer to future aspirations, they refer to a factual situation which, if he is telling the truth, actually ALREADY exists. And he specifically said "we have plans..."

It is for these reasons I have asked you to supply me with the fully dimensioned drawings upon which Cllr Hitchins has based his remarks (ie those 'plans' he has referred to) and any other necessary information so that I may have full understanding of his numbers and how he has arrived at them. And at the same time those drawings will show how he can claim to Full Council that "there is an increase in green space." Please comply with my very clear request.

You seem to be obliquely suggesting, in your response, that there are no such precise fully dimensioned drawings or plans currently in existence. If this is the case, and if neither Arun DC nor Cllr Hitchins has any other factual information which will have to include measurements (NOT vague future aspirations), please will you clearly say so, so that this matter can be concluded.

I have now conducted the internal review of your Freedom of Information request relating to parking space numbers in Arun’s Hothamton Linear Park proposals.

Your request was to be supplied with:

1. fully dimensional drawings upon which Councillor Hitchins had based remarks on parking spaces still remaining at 199; and
2. any other necessary information to aid your full understanding of Councillor Hitchins’ numbers and how he arrived at them.

The response received, provided by the Group Head of Regeneration, Denise Vine, confirmed that the proposals prepared by the landscape consultants were concept designs and explained how the figure of 199 spaces had been arrived at. It also confirmed the next stage of work.

In conducting my internal review, I have considered firstly whether your original request was answered fully; and secondly what recorded information is held by Arun District Council.

Responding to your first request – to be supplied with fully dimensional drawings - I do accept that the response provided has not specifically answered this request. I have therefore reviewed this request further and can confirm from this that the Council does not hold fully dimensional drawings. The Council does, however, hold drawings provided by the landscape designers but these do not show a scale or dimensions. The majority of these drawings have already been in the public domain.

Responding to your second request – to be supplied with any other necessary information – in my view the response did answer your request as it explained how the maximum number of parking spaces could be retained and the next stage of work to undertake the necessary surveys and investigations of the site.

In seeking information to inform this review, the Group Head of Regeneration has provided some additional information on this subject that I have provided below:

“After feedback from Members to increase the car parking numbers the landscape designers provided a drawing which illustrated how by removing some of the pathways and landscaping more spaces could be provided - I attach a copy of the drawing - the 'X' indicates where additional spaces could be provided.

With these changes the designers confirmed that 199 spaces could be provided."

Thank you for confirming that the Council does not hold fully dimensional (sic) drawings.

However you have not properly addressed my second request, which you incorrectly summarised as: "to be supplied with any other necessary information". My request was : "and any other necessary information so that I may have full understanding of his numbers and how he has arrived at them. The information you have supplied goes NOWHERE towards giving me a full understanding of his numbers and how he arrived at them. The additional drawing merely shows a gain of 18 spaces and a loss of 15 trees. This does not show his specifically quoted figure of 199 spaces or how they are to be squeezed into the space available.

Please supply the "other necessary information" in conformity with the specification I supplied to you in my second request as I have quoted above. If you do not have this information. please clearly say so.

You state: "with these changes the designers confirmed that 199 spaces could be provided." You do not state HOW they confirmed this. It is impossible to "confirm" this without dimensions. What dimensions were they working to? Anything less than this is just a guess. Please supply full details of their "confirmation" and the figures involved and how they arrived at them. If you do not have any of this, please clearly say so.

And please will you re-supply the Pdf of the "additional spaces" The one you supplied will not correctly download. Also, I should be interested to know the date that this drawing was prepared.

This continued delay is quite extraordinary, since the assertions by Cllr Hitchins referred to in my request date from before 10th January, and it is reasonable to assume that he would not have made those assertions without the information I have requested being to hand at the time. Why on earth should you not be able to supply this to me immediately?

I am reluctant to say this, but the obvious conclusion is that the material you intend to supply to me is being created now (quite possibly without your knowledge or involvement) and will be backdated for my benefit. I must therefore ask you to also supply incontrovertible evidence that anything you supply to me now was in existence prior to 10th January. I have now reviewed your request of 8 February 2018 and further email of
22 February 2018 in which you seek further clarification following my
internal review of your Freedom of Information request relating to parking
space numbers in Arun’s Hothamton Linear Park proposals.  I note that you
have accepted my response to your first request, however you are still
asking that you be supplied with “other necessary information” to support
your understanding of the car parking numbers as referred to in your
second request.

 

I did believe I had addressed both your requests from my internal review. 
However, in view of your concerns on the second request, I have again
reviewed the information held by the Group Head of Economy.  I have also
looked again at the information available in the public domain from the
meeting of the Bognor Regis Regeneration Sub-Committee held on 14 December
2017.  The report presented to the Sub-Committee confirmed that Appendices
C and D had been categorised as exempt information as defined under
paragraph 3 of Schedule 12A of the Local Government Act 1972, as amended. 
I have already confirmed to you in my letter of 21 February 2018 that this
information cannot be disclosed. 

 

In reviewing what “other necessary information” the Council can provide, I
confirm that there are no detailed proposals, as already confirmed in my
email of 8 February 2018, as the proposals are still at the conceptual
stage. 

 

What was provided to the Group Head of Economy ahead of the meeting of the
Bognor Regis Sub-Committee on 14 December 2017 was advice by email from
the Council’s Consultants, Urban Delivery.  I have reviewed this
information and have listed below extracts that are relevant to your
Freedom of Information request as shown in italics below. 

 

1.      Email from Denise Vine to Simon Davis at Urban Delivery dated 7
December 2017 at 1641 asking “Is it possible to measure the sq. footage of
the car parking area, excluding all the additional landscaping, and
compare this with the sq. footage of the existing car park?”

 

2.      An email response was provided from Simon Davis at Urban Delivery
to Denise Vine dated 8 December 2017 at 1201 stating ”OS data is not very
accurate so these figures are not exact and are not sure what purpose this
comparison demonstrates as the figure for the proposals includes in part
existing access roads.  Currently the area of the existing car park is
5555m.sq although this includes areas of soft landscape.  The area of the
proposed car park, including the 2no. access roads, is 4780m.sq although
again this includes the soft landscape where the avenue of trees are
located, but not the rain gardens.”

 

3.      This email from Urban Delivery also confirmed the information
already provided to you on the number of parking bays to be provided, as
stated in the 3^rd paragraph of the response sent to you on 26 January
2018 by the Information Management Team. 

 

BD Landscape provided the drawing I attached to my email of 8 February
2018.  I note you cannot download this, unfortunately, this is the only
format that we hold this drawing in.  If you wish to view this at the Arun
Civic Centre, Littlehampton or Bognor Regis Town Hall, please contact
Denise Vine, the Group Head of Economy to arrange a convenient time to do

Thank you for your email of 27th February. However, you have still failed to supply what I requested, merely repeating in your item No 3 what you said before, saying "...Urban Delivery also confirmed the information already provided to you on the number of parking bays..."

In my email of 8th February I said: "You state: "with these changes the designers confirmed that 199 spaces could be provided." You do not state HOW they confirmed this. It is impossible to "confirm" this without dimensions. What dimensions were they working to? Anything less than this is just a guess. Please supply full details of their "confirmation" and the figures involved and how they arrived at them. If you do not have any of this, please clearly say so."

It is not enough to say they "confirmed" it. And you use the words "could be" which are entirely vague. That's just somebody plucking words out of the air. If they confirmed it I wish to know the figures and dimensions they were working to so that I can see how they arrived at that "confirmation". And if you do not have this information, I repeat, PLEASE CLEARLY SAY SO. It will then be clear to me whether Cllr Hitchins was speaking from actual factual knowledge of figures and dimensions, or was simply repeating unchecked guesswork from somebody who hadn't actually bothered to work it out.

Please supply what I ask for, instead of vague and unchecked assertions. If you haven't got it, please clearly say so.
