Parking Fines distribution and income per street Tunbridge Wells

I request the raw data set of parking tickets - both on and off-street -
issued in the name of Tunbridge Wells Borough Council in the
3 years to 30/09/2019 broken down by: date, time, street name, Post code, officer ID, Appeal status (i.e. was the parking ticket appealed or not),appeal date if applicable, contravention type.
Can you also provide in a spreadsheet the gross income generated by parking fines with identifier for month, year, street, postcode, detailing all the roads in the council area for the same period, (3 years to 30/09/2019).

Thank you for your Freedom of Information request.

Please find below the response to your recent request. The information has
been provided by our Parking Team.

Your request: I request the raw data set of parking tickets - both on and
off-street - issued in the name of Tunbridge Wells Borough Council in the
3 years to 30/09/2019 broken down by: date, time, street name, Post code,
officer ID, Appeal status (i.e. was the parking ticket appealed or
not),appeal date if applicable, contravention type.

 

Can you also provide in a spreadsheet the gross income generated by
parking fines with identifier for month, year, street, postcode, detailing
all the roads in the council area for the same period, (3 years to
30/09/2019).

 

I can confirm that we are able to provide the following information with
regard to your request:

 

Date, time, street name and contravention type relating to Penalty Charge
Notices issued for the requested time period.

 

We are also able to provide gross income by month and year generated by
Penalty Charge Notices for the requested time period.

 

This information has been provided in the attached spreadsheet.

 

We consider that information relating to Officer ID is exempt under
Section 40 (2) of the FOI Act.   Section 40(2) of the FOIA states that
information is exempt from disclosure if it constitutes the personal data
of a third party and its disclosure under the FOIA would breach any of the
data protection principles under the Data Protection Act. We consider that
the data protection principle which would be contravened by disclosing the
information would be the first data principle that ‘personal data shall be
processed lawfully, fairly and in a transparent manner in relation to the
data subject’.

 

Tunbridge Wells Borough Council considers that Civil Enforcement Officers
are identifiable by their Officer ID and that this information constitutes
personal data as set out in the Data Protection Act 2018.

 

In assessing whether disclosure of the information would be lawful, we
have to consider whether processing personal data in response to your
request meets a condition under Article 6 of the General Data Protection
Regulations.  We consider that the most appropriate condition would be
‘processing is necessary for the purposes of the legitimate interests
pursued by the controller or by a third party except where such interests
are overridden by the interests or fundamental rights and freedoms of the
data subject which require protection of personal data.

The Council recognises that you have a legitimate interest in the
disclosure of the information, however we consider that disclosure of the
information into the public domain is not necessary to meet your
legitimate interest and we also do not consider it is in the wider public
interest.  We consider that disclosure of the information would be unfair
to the third parties and would breach the first data protection principle.
 In assessing fairness, we have considered the reasonable expectations of
the third parties, the nature of those expectations and the consequences
of disclosure.  If we were to disclose this information we would be
processing the data in a way which was not intended by the third parties
concerned.  We also consider that disclosure of individual statistics
regarding Civil Enforcement Officers would be unfair to those individuals
who, as employees, would have a reasonable expectation that this data
would not be made public and it may have unjustified adverse effects on
the employee concerned due to the nature of their role.

We can also confirm that we hold information in respect of the following
information:

 

Appeal status, appeal date, income generated by parking fines by street,
postcode and road.  

 

However, we consider that this information is exempt under Section 12 of
the Freedom of Information Act.  Under Section 12 of the Freedom of
Information Act and the Freedom of Information and Data Protection
(Appropriate Limit and Fees) Regulations 2004 the appropriate cost limit
to respond to a request is £450. At the statutory calculation of £25 per
hour of work this means that a request can be considered excessive were it
to take more than 18 hours of work. A request above this limit can be
refused under section 12 of the Act.

 

We consider that the information requested in regards to appeal status,
appeal date, income generated by parking fines by street, postcode and
road would exceed the limit set out above.  There is no reporting
mechanism to extract the above data from the Council’s parking system and
therefore the information would need to be manually extracted by searching
each individual Penalty Charge Notice.  We have been informed by our
Parking Team that in order to collate the information requested, an
officer would have to manually search each PCN and extract the relevant
information.  For each record, this would take a minimum time of
approximately two minutes.  There are approximately 119,112 Penalty Charge
Notices identified during the requested timeframe. Therefore, it has been
estimated that this would exceed the £450 statutory limit.

 

If you are able to refine your request, we may be able to reconsider your
request and assist with providing information within the appropriate limit
set out above.
