Parking Fines

Dear Leicestershire County Council,

1) The law I believe allows parking fines of between £40 & £70 (before prompt payment discount) to accommodate the seriousness of the offense. For each of the past 3 years what information exists that shows the number of fines issued at £70, £60-69, £50-59, £40-49? The 3 bands I have used are arbitrary and I’d be happy to accept information that is reasonably close – I want to see to what degree LCC uses its discretion to reflects the intentions behind the tiered payment scheme.

2) Consider the two offenses:

i. Parking in a disabled bay when neither the driver nor any passengers are disabled – i.e. someone who is NOT entitled to use it who potentially deprives a disabled driver from using the bay.

ii. Parking in a disabled bay when the driver is disabled but forgets display their blue badge – i.e. someone who IS entitled to use it and does not therefore deprive anyone of anything.

Clearly ii) is far less serious than i) and therefore would warrant a lower fine as indicated by the legislation.

a) Does LCC agree that this is the case? i.e. that ii) is less serious than i)

b) What information exists to show that LCC reflects the stated intention of the legislation by fully utilising the flexibility is has, as opposed to treating all offenses equally by issuing fines at the £70 maximum with little or no variation regardless of seriousness?

c) Administrators will have guidelines explaining how to apply different levels of fine correctly and consistently, probably using examples of serious and not-so-serious offenses. Where can I find a copy?
