Parking fines

Dear sir/madam,

I am writing to make an open government request for all the information to which I am entitled under the freedom of information act. In order to assist you with this request, I am outlining my query as specifically as possible. If however this request is too wide or too unclear, I would be grateful if you could contact me as I understand that under the act, you are required to advise and assist requesters.

I am requesting the following information:
I would like to know the total number of parking fines issued by the council over the past five years across the council's boundary, up to the most recent set of figures.

I would also like to know the total value of these fines.

With data above I would also like a breakdown of the locations where these fines were issued. I am however wary that a request for broad locations may be at risk of exceeding the budget for an FOI request.

Please provide me a minimum of 10 to 15 streets in the borough which have highest number of parking charges issued by the council on record. If not please provide me the breakdown for locations across the district where the council has issued fines.

With my 10 to 15 street request, please provide a set number of streets across the five year period.

On these, please include a number for the amount of charges and the value of these fines.

Could the officer also provide a summary council's remit for issuing parking fines.

I understand that under the act, I should be entitled to a response within 20 working days. I would be grateful if you could confirm via email that you have received this request. Ideally I would like the information outlined in my request emailed to me. I look forward to hearing from you in the near future.

Freedom of Information Act
This covers general recorded information that is held by the Council.
Examples: budget information, staff structures, details of contracts etc

From the next working day that the request is received we have 20 working
days to respond. This does not take in to account any clarification we may
require or if we need to consider the Public Interest Test which allows us
up to a maximum of 20 additional working days.

Environmental Information Regulation
This covers all environmental information held by the Council.
Examples: Planning Applications, details of proposed road works, flood
information, pollution information etc.

From the next working day that the request is received we have 20 working
days to respond.

Section 7 of the Data Protection Act (Subject Access Request)
This section of the Data Protection legislation only relates to requests
for information about the requester or a client if you are acting on their
behalf.
Examples: Personnel file, Housing file, Council Tax/Housing Benefit
information etc.

We have 40 days from the date of receipt to respond.

With regard to your Freedom of Information request received on 2 April
2019, please find our response below.

 

We must inform you that, in accordance with Section 12 of the Freedom of
Information Act, we are unable to fully answer your enquiry without
exceeding the time/costs limits under the Act.  Where a local authority
reasonably estimates that it would cost more than £450 (or 18 hours of
staff time) to fulfil a request it is not required to do so.

 

Whilst this is a strict interpretation of the Act, the Council policy is
to provide a balance between the needs of the requester and the use of
resources to ensure effective service provision is maintained.  We
therefore provide the following responses to your questions.

 

 

I would like to know the total number of parking fines issued by the
council over the past five years across the council's boundary, up to the
most recent set of figures.

This also includes a PDF documents titled ‘Parking Enforcement Report’. 
The last financial year (2017-2018) is soon to be inputted onto the
system.

 

I would also like to know the total value of these fines.

 

It is estimated that your request for the value of fines will be above the
£450 time/cost limit because there are too many variables to consider. 
Different contravention types incur different rates.  Penalty Charge
Notice’s will be paid at discount as well as at the full rate depending on
each case and some are not paid at all which incur further costs, as well
as progressing to the Traffic Enforcement Centre and then ultimately the
Bailiff where recovery orders and warrants are issued.  There is no report
which we can produce that gives us this information so it would be a case
of reading up on each case and tallying the figures which we estimate
would exceed the time/cost limit described above.

 

With data above I would also like a breakdown of the locations where these
fines were issued. I am however wary that a request for broad locations
may be at risk of exceeding the budget for an FOI request.

 

It is estimated that your request will be above the £450 time/cost limit
because hundreds of records would have to be manually looked at and
various reports run off to transfer and cross-reference data.

 

Please provide me a minimum of 10 to 15 streets in the borough which have
highest number of parking charges issued by the council on record. If not
please provide me the breakdown for locations across the district where
the council has issued fines.

Please find a spreadsheet attached containing PCN (Penalty Charge Notice)
numbers from 2010 to 2017 and the top ten streets were fines were issued.

 

Unfortunately we have been unable to produce this same report for 2018 to
the current date; however we provided a separate spreadsheet for the top
20 streets with the highest number of parking charges.

 

Could the officer also provide a summary council's remit for issuing
parking fines.

 

Hull City Council issued all Penalty Charge Notices in accordance with the
Traffic Management Act 2004 and the Highway Code.  Each case has to meet
criteria where they are parked in contravention.
