You are wrong Bryan Rylands. Plenty of public authorities state in FOI responses that they are subject to copyright. Even if they don't say it, it does not mean that it isn't subject to copyright.

Countless billions of taxpayers money has been spent on creating information held by public authorities. Their value is greater than the value of tangible assets owned by public authorities.

As a taxpayer you should be grateful that it's copyrighted and protected from profiteers.

E-mail from Bryan:

"Andy Smith,

I am asking for clarification of the copyright. I am not saying they cannot copyright, please do read what is written, not what you think is written.
Yours,

Bryan"

Please forgive my ignorance Bryan, I interpreted "please might you outline how this data is copyrighted to EKHU Trust, when no other local councils use this clause" as meaning that you challenged their copyrighting the data. Stupid me.

Dear Mr Rylands

Further to your email below, our original response has also been reviewed and amended following a slight anomaly with the values. Please find attached a revised response.

With regard to copyright issues and permission for re-use, the information is published already on the EKHUFT Website as per the below link:
http://www.ekhuft.nhs.uk/patients-and-vi...

You are free to copy, re -publish, distribute and transmit the information, however whilst doing so you must acknowledge the source of the information in their product or application by including or linking to any attribution.

When giving access to information under the Act, the Trust cannot place any conditions or restrictions on that access. However, the Trust can include a copyright notice with the information it discloses.

The Information Commissioner's Office encourages public authorities to use the open government licence provided by the National Archives. Local Councils would fall under this licence also.

Should you require any further information the ICO Website is very informative:
