I am writing regarding your request for information, which was received on
23.10.18.

 

In that request you asked us for information below:

 1. Please can you confirm how many Parking Fines the Council registered
with Traffic Enforcement Centre in: 2016, 2017, 2018
 2. Please confirm how many PCN’s were issued to external agents in the
last financial year, and provide the split between the various
enforcement agents/bailiffs.
 3. Please can you confirm what software you use for Parking Enforcement
(PCN issue and processing)
 4. Please can you confirm when the last contract award for Parking Fine
enforcement agents/bailiffs was and how long the contract is for?
 5. If possible, can you send me a copy of the last letter awarding the
contracts for enforcement agents/bailiffs?

I can confirm that the search for the information you requested has been
completed and I can advise you of the following:

 

 1. Parking Fines the Council registered with the Traffic Enforcement
Centre:

2016 - 6,682

2017 - 7,681

2018 - 5,603

 2. PCNs issued to external agents in the last financial year between
enforcement agents/bailiffs:

Marston Group – 1,593

Newlyn PLC – 3,728

 3. Si-Dem Debt Management System is the software used for Parking
Enforcement.
 4. The Parking Enforcement, Car Park Management and Associated Services
contract was awarded on 01.01.16 and will run for 84 months with an
option to extend for a further 24 months.
 5. Under Section 43(2) of the Freedom of Information Act, information is
exempt from disclosure if complying with the request “would, or would
be likely to, prejudice the commercial interests of any person
(including the public authority holding it)”. Information given under
the Freedom of Information Act puts that knowledge into the public
domain. The information that you have asked for is relevant to a bid
that may be made as a part of our tender process. This could confer an
unfair advantage on a tenderer that had this information over a
tenderer who did not. This would potentially result in the Council not
receiving the best value for money. I conclude that providing you with
this information would be potentially harmful to the commercial
interests of Southend-on-Sea Borough Council, and in accordance with
Section 43(2) of the Freedom of Information Act 2000 I am therefore
refusing your request to provide this information. In applying this
exemption, I have considered the public interest in releasing this
information and any potential harm that might result from its release.
In this case, disclosing this information would reduce our ability to
negotiate or compete in a commercial environment. Protecting the
commercial interests of the Council ensures that we are able to
receive best value for money. I therefore conclude that the public
interest does not outweigh the potential prejudice to the commercial
interests of Southend-on-Sea Borough Council.

decision although generally the ICO cannot make a decision unless you have
