Dear Hertsmere Borough Council,

Rule 244 of the Official Highway Code states: You MUST NOT park partially or wholly on the pavement in London, and should not do so elsewhere unless signs permit it. Parking can seriously inconvenience pedestrians, people in wheelchairs or with visual impairments and people with prams and pushchairs.

Please can you confirm how many Penalty Charge Notifications were issued in 2013/14, 2014/15, 2015/16, 2016/17 and 2017/18 for parking with one or more wheels on or over a footpath or any part of a road other than a carriageway in Bushey?

I am writing in response to your Freedom of Information request received 2
February 2019.

 

Your request has now been considered under the terms of the Freedom of
Information Act and/or Environmental Information Regulations and we are
able to respond as follows:

 

Your Request:

Our Response:

 

Outside of London the rules are different when it comes to enforcement of
pavement parking. The council parking enforcement officers can only issue
a ticket to a vehicle parked on the pathway if there is a parking
restriction in place, such as a yellow line. Outside of the restriction
times and if there are no parking restrictions in place the Council
parking enforcement Officers cannot enforce against the vehicles. If the
vehicles were causing an obstruction of the pathway, then it would be for
the Police to enforce for obstruction.

 

It is not possible to select this criteria from the Parking software
system into a report. If there is a particular location in the Bushey area
that is of a concern then it may be possible to search the system images
but would take some considerable time.
