Parking enforcement

Dear Thanet District Council,

Under the FOI and in light of recently reported events relating to parking enforcement I would be grateful of the following disclosure.

In the period 01/01/17 to 21/3/18

Without naming any of the enforcement wardens a non descript number will suffice. For example no1 no2

How many tickets have each of the officers issued during this period
How many of these tickets were for pay and display offences
How many of these tickets were for real parking offences, yellow lines etc
How many of the tickets for each officer have been subject to a successful appeal.
How many tickets were issued outside of 9-6 Monday to Friday
On a Saturday 9-6
On a Sunday at any time.

In respect of general parking.

How many tickets have been issued to non UK registered vehicles
How many vehicles of any description have more than 5 unpaid tickets
10 unpaid tickets
20 unpaid tickets
50 unpaid tickets
75 unpaid tickets
Over 100 unpaid tickets.
Highest number of tickets issued to one vehicle

Finally
In the same period between April 2015 and March 2018 in respect of the
mill lane multi story
Leopold street multi story.

Please confirm the income per month that has been connected from the pay and display machines - excluding free or paid permits.

In the same period the amount that has been spent on each of the car parks to include deep cleaning, repairs, maintenance, general cleaning and improvements to the cctv systems.

We refer to your Freedom of Information request and the Information
Commissioner's decision in FS50781472.

 

Firstly, I sincerely apologise on behalf of the Council for the delay in
dealing with your information request. This is due to a combination of
administrative issues and a significant increase in requests in recent
months.

 

Our response to your request is set out below:

 Request 1

Without naming any of the enforcement wardens a non-descript number will

How many tickets have each of the officers issued during this period How
many of these tickets were for pay and display offences How many of these
tickets were for real parking offences, yellow lines etc How many of the
tickets for each officer have been subject to a successful appeal. How
many tickets were issued outside of 9-6 Monday to Friday On a Saturday 9-6
On a Sunday at any time. Identifying officers by numbers could identify
individuals. Therefore the Council relies on Section 40 of FOIA 2000 which
provides an exemption from the right to know where the information
requested is personal data protected by the Data Protection Act 1998.

Section 40(2) of the Act provides that, the personal data of a 3^rd party
may be withheld if its disclosure would be to someone other than the third
party; and the disclosure would contravene any of the data protection
Principles of the Data Protection Act 1998, especially the first data
protection principle that, disclosure of third party information must be
fair and lawful.

 

We consider that this third party information was provided in the
reasonable expectation that it would only be used confidentially by the
Council; and not to be published or disclosed to the whole world for any
other reason. Under the Act, we are required to consider the impact of
3^rd party disclosure in the widest possible sense. 

On this basis, we are unable to provide you with this information.

 

Request 2

In respect of general parking How many tickets have been issued to non UK
registered vehicles We are unable to provide this information because we
do not know the time period that you want your request to cover.

 

Request 3

How many tickets have been issued to non UK registered vehicles? See
response in Request 2.

 

Request 4

How many vehicles of any description have more than: 5, 10, 20, 50, 75,
over 100 unpaid tickets?  See response in Request 2.

Request 5
Highest number of tickets issued to one vehicle? See response in Request

Request 6

Finally, in the same period between April 2015 and March 2018 in respect
of the Mill Lane multi story Leopold street multi story.  Please confirm
the income per month that has been connected from the pay and display
machines - excluding free or paid permits. Please see attached sheets.

 

Request 7

In the same period the amount that has been spent on each of the car parks
to include deep cleaning, repairs, maintenance, general cleaning and
improvements to the cctv systems. This information is not readily
available in the format requested. To collate and provide an accurate
amount would require extensive interrogation of numerous data sources
which would take a considerable amount of time.

 

Consequently, we are refusing this information by relying on Section 12
(1) of the FOIA, which allows a public authority to refuse to comply with
a request of information where the cost of compliance is estimated to
exceed the appropriate limit of £450.00.

 

Next Steps

ask for an internal review by submitting a request within two weeks of the

I am writing to request an internal review of Thanet District Council's handling of my FOI request 'Parking enforcement'.

The dates were supplied, officers details were asked as generic not with an identifier, you know there is a data base of cars with tickets outstanding as a warden informed several members of the public.

There must be audited accounts for expenditure and you know that Margate mill lane receives a huge amount of expenditure over leopold street.

I have reported this matter to the information Commissioner’s Office as it has taken 9 months for your refusal. I can only asssume the reasons for not disclosing it.

appeal.  

Thanet District Council holds the information you requested however we are
unable to provide the information you have requested as we have calculated
that it would take in excess of 18 hours to collate. Therefore the
information is exempt from publication under Section 12 of the Freedom of
Information Act – Exceeds Costs Limits as we don't hold the information in
this format. that would require individual examination of all the records.

 

We have estimated that the time required to review the stored files and
research the records and other documentation would take more than 18
hours.

 

The appropriate limit specified in regulations for the Council is set at
£450. This represents the estimated cost of one person spending 2½ working
days in determining whether the Council holds the information, and
locating, retrieving and extracting the information. Consequently the
Council is not obliged under Section 12 of the Freedom of Information Act
2000 to respond to your request and we will not be processing your request
further.
