Request for Information – Parking Charge Notices

 

I refer to your request for information dated 27 September 2017.

 

The information you requested was:-

have been issued the most by Perth and Kinross Council over the last 3
months (July2017 - September 2017)

 

Response

 

Relative to the above, I have been advised of the following:

 

1.    3,558

 

2.    1,985 payments were made.

 

Section 12(1)

Excessive Cost of Compliance

 

Section 12(1) of the Freedom of Information (Scotland) Act 2002 states
that “Section 1(1) does not oblige a Scottish public authority to comply
with a request for information if the authority estimates that the cost of
complying with the request would exceed such amount as may be prescribed
in regulations made by the Scottish Ministers”.

 

I am advised that there is no current system in place to provide the
revenue received from these payments other than systematically and
manually working through all PCNs issued in this period. Perth & Kinross
Council do not hold financial records in such a way that this information
can be easily extracted. Once a payment is received, the case is closed.
This request would involve 3,558 such PCNs, and I believe that it is not
reasonable to carry out this request.

 

I therefore must inform you that under Section 12(1) of the Act, the
council is not supplying the information on the grounds of excessive cost.

 

Excessive Cost

 

Paragraph 5 of the Scottish Statutory Instrument 2004 No.467 – Freedom of
Information (Fees for Required Disclosure) (Scotland) Regulations 2004
prescribes the cost limit (for the purposes of Section 12(1) of the Act),
as £600.

 

Paragraph 3 of the Scottish Statutory Instrument 2004 No.467 – Freedom of
Information (Fees for Required Disclosure) (Scotland) Regulations 2004
requires Scottish public authorities to make reasonable estimates of
projected costs likely to be incurred in locating, retrieving and
providing the information requested. 

 

Estimate of Projected Cost

 

In order to make a reasonable estimate of the total cost of complying with
your request we have conducted an exercise to calculate the total number
of hours that would be required to comply with your request.

 

Volume of material

 

·         Perth & Kinross Council would have to produce bills for 3,558
PCNs.  

 

·         An hourly rate of work was established to calculate the average
amount of time required to retrieve the necessary material to fulfil the
request. On average 30 PCNs were retrieved and examined and information
extracted in 1 hour (approximately 2 minutes per PCN).

 

·         Based on the number of PCNs and the average hourly rate, the
following hourly total was calculated:-

 

3,558 divided by 30 (the number of historic accounts that can be examined
in an hour) resulting in a total of 118.60 hours.

 

Financial value

 

In order to arrive at a financial value for the request and to establish
whether the work involved in fulfilling the request could be considered
excessive in terms of the Act we calculated a figure for the cost of staff
involved in fulfilling the request.

 

·         Under Paragraph 3(2)(b) of the Scottish Statutory Instrument
2004 No.467 – Freedom of Information (Fees for Required Disclosure)
(Scotland) Regulations 2004 Scottish public authorities are permitted to
charge up to £15 per hour per member of staff in any estimate of the cost
of staff time in retrieving, examining and extracting the information
requested.  We have used this hourly rate to reflect the type of staff
that would be likely to be involved in this process.

 

·         The request time of 118.60 hours multiplied by £15 results in a
total of £1,779.

 

The total staff cost for providing the information is therefore £1,779.

 

The cost of complying with your request for information is clearly in
excess of the £600 prescribed under the Fee Regulations. As stated above,
under Section 12(1) of the Freedom of Information (Scotland) Act 2002, the
Council is therefore not obliged to provide the information you requested.
