Freedom of Information Request 12804: Paranormal Activity, Zombie Invasions, and UFO Sightings

I am writing regarding your request which I received on 29 August, 2014. In your request you asked for the following information:

• I would like to know the number of UFO sightings and investigations into paranormal activity you have dealt with in the last 10 years.

• I would also like a copy of your business continuity plans, and all your processes to protect personal information of staff and clients, should there be an invasion of zombies or and kind of viral infection that could cause a pandemic.

Under Section 14(1) of the Freedom of Information Act (the Act) the council is not obliged to comply with a request for information if the council deems the request to be vexatious.

From the information supplied in your request and with regards to the guidance issued by the Information Commissioner’s Office (ICO) on ‘Dealing with Vexatious Requests’, which is available on the ICO’s website, I am of the view that your request regarding UFO, Paranormal activity and zombies is vexatious.

The Upper Tribunal has previously concluded that ‘vexatious’ could be defined as the ‘manifestly unjustified, inappropriate or improper use of a formal procedure, therefore I consider your request to be an inappropriate use of the right of access to information afforded by the Act.

My decision is based on the fact that the subject matter of your request is inane or extremely trivial and the request appears to lack any serious purpose and is solely made for the purpose of amusement.

As previously stated, under the provisions of Section 14(1) of the Act, the council is not required to comply with this part of your request.

Leeds City Council’s Public Health team works alongside Public Health England, Leeds Community Healthcare Trust and the Leeds Teaching Hospitals Trust to reduce the risks associated with infection and to respond to the threat of outbreaks like pandemic flu and, more commonly, gastroenteritis.
