Your request was received on 10th May 2021 and you will be sent a response within 20 working days (of receipt) in accordance with the Freedom of Information Act 2000/ Environmental Information Regulations 2004 (EIR), subject to the information not being exempt or containing reference to a third party.

The Information Commissioner’s Office (ICO) recognises the unprecedented challenges all are facing during the coronavirus (COVID-19) pandemic.

In particular they understand that resources, whether they are finances or people, may be diverted away from usual compliance or information rights work. Whilst the ICO can’t extend statutory timescales, they will not be penalising public authorities for prioritising other areas or adapting their usual approach during this extraordinary period.

Therefore while the Council will make every effort to comply with the Statutory Requirements you may experience understandable delays when making information rights requests during the pandemic.

I am writing to let you know that the Authority requires further
information.  Section 1. (3) (a) of the FOIA  provides that
 
“Where a public authority -
 
(a) reasonably requires further information in order to identify and
locate the information requested, and
(b) has informed the applicant of that requirement,
 
the authority is not obliged to comply with subsection (1) unless it is
supplied with that further information.”
 
You have requested information
 
1. Please provide details of all contracts awarded by Oxford Direct
Services since March 2020 where they have made use of third party painting
contractors.
 
2. Please provide the names of the companies that have provided painting
personnel.
 
Are you able to clarify what information it is that you wish to receive
please?
 
Due to the volume of external contracts that ODS have in place that may
include third party painting work, the time needed to undertake the
research is likely to exceed the maximum time allowed to identify this
information. It would therefore be helpful if you could identify your
particular area of interest to narrow the scope of your request.
 
Moreover, I am of the opinion that retrieving the information you require
would possibly exceed 18.5 working hours and consider Section 12 of the
FOIA could apply in this instance.
 
Section 12 of the Act makes provision for public authorities to refuse
requests for information where the cost of dealing with them would exceed
the appropriate limit, which for local government is set at £450. This
represents the estimated cost of one person spending 2.5 working days in
determining whether the department holds the information, locating,
retrieving and extracting the information.
 
It would be helpful if you could be more specific in describing the
information you require.
 
The 20 working days timeframe for responding to your request will be
paused  from 12th May 2021 until the Authority has been supplied with
further information. Should the Council not receive a response to this
email by 28th May 2021, your request will be closed accordingly.

I am writing to request an internal review of Oxford City Council's handling of my FOI request 'Painting Contracts awarded by Oxford Direct Services'.

I requested answers to the following questions:

1. Please provide details of all contracts awarded by Oxford Direct
Services since March 2020 where they have made use of third party painting
contractors.

2. Please provide the names of the companies that have provided painting
personnel.

You refused to answer the question as you suggested that it would take in excess of 2.5 days to find answers to the question. This is nonsense.

If it makes things easier, I would like to know specifically what painting contracts were awarded to Trident Maintenance Services Limited and Mitie Property Services, including the to and from dates the painting contracts were undertaken and the site locations.

I would also like to know how many of Oxford Direct Services own painters were on furlough at the time any third party painting contractors were employed by Oxford Direct Services?

I do not believe it will take in excess of 2.5 days to provide answers to the above questions.

Further to the email below, I can now respond to your Freedom of
Information Act 2000 request  as follows:

 

If it makes things easier,

 

I would like to know specifically what painting contracts were awarded to
Trident Maintenance Services Limited and Mitie Property Services,
including the to and from dates the painting contracts were undertaken and
the site locations.

 

Each year ODS uses a number of painting contractors to carry out the
seasonal external pre paint joinery work for areas of Oxford. When ODS
requires this work to be carried out the painting contractors are provided
with the opportunity to submit competitive quotes.  

 

The contract for the painting work is created when a Purchase Order (PO)
is issued and the contractor agrees to carry out the work. The actual
dates each area is completed is not known as this is managed by the
contractor.

I would also like to know how many of Oxford Direct Services own  painters
were on furlough at the time any third party painting  contractors were
employed by Oxford Direct Services?
