We're waiting for Eric Bernston to read a recent response and update the status.

Dear Oxford City Council,

I would like to know details of all contracts awarded by Oxford Direct Services to WKH Fencing in the past two years. I have attempted to find the information on the Oxford Direct Services website but was unable to find any such information. Can you confirm that Oxford Direct Services is obliged to make this information publicly available?

Please provide the following information:

1. Cost and dates of contracts awarded.
2. Scope of work undertaken.
3. Details of contractors who put in bids for the work ultimately awarded to WKH Fencing.

Your request was received on 6th October 2021 and you will be sent a response within 20 working days (of receipt) in accordance with the Freedom of Information Act 2000/ Environmental Information Regulations 2004 (EIR), subject to the information not being exempt or containing reference to a third party.

The Information Commissioner’s Office (ICO) recognises the unprecedented challenges all are facing during the coronavirus (COVID-19) pandemic.

In particular they understand that resources, whether they are finances or people, may be diverted away from usual compliance or information rights work. Whilst the ICO can’t extend statutory timescales, they will not be penalising public authorities for prioritising other areas or adapting their usual approach during this extraordinary period.

Therefore while the Council will make every effort to comply with the Statutory Requirements you may experience understandable delays when making information rights requests during the pandemic.

Dear freedomofinformation,

Thank you for your response, however, the information you have supplied is ambiguous and I would like further clarification.

1. You have not provided dates the contracts were awarded.

2. I require more information regarding scope of work undertaken. I would like specific project details, locations of work undertaken etc.

3. You have provided the names of five contractors who were awarded work as part of the fencing programme. I did not ask for this information. I specifically asked for the names of contractors who submitted bids for the same contracts that WKH Fencing were awarded. If you are unwilling to release this information, I would like to know how many bids from other contractors were submitted for the contracts that were awarded to WKH Fencing.

Thank you for your reply.

Over 430K on fencing is a lot of council tax contributions. Is there anyway the public can scrutinise this contract in more details so as to see where exactly the money has gone? For example, how much fencing was installed, number of man hours spent on project etc?

My remit is to manage the Freedom of Information process, the question you are asking would not constitute a Freedom of Information Request but rather a question in relation to how a contract is managed. The particulars of a contract are confidential between the parties of said contract.

If you have a complaint in relation to how Oxford Direct Services are managing this contract then I would advise you to put this in writing to their complaints officer.

I have just checked to make sure that isn't due to anything my end and can confirm that my sent email still shows the email address. I believe what has probably happened is that because the email address is considered a personal email under GDPR that Whatdotheyknow remove this before the response is published.

If you want to send me your non-whatdotheyknow email then I will forward my previous email onto you. If you do not wish to do this for any reason then I suggest you write into ODS and they can respond to your correspondence.
