Dear Arun District Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Arun District Council's handling of my FOI request 'Ownership and related lease details of properties in Waterloo Square, Bognor Regis'.

[ Your refusal is based on entirely unsound premises - I asked for copies of documentation, the Land Registry does NOT have these and so I seek compliance with what was asked originally, that is copies of stated documents. The response is a disgrace.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/o...

Yours faithfully,

Jan Cosgrove

Infomanagement, Arun District Council

Dear Mr Cosgrove

RE: Feb19_10

I have been referred to your email of 26 February 2019 in which you
request a further review of the response given to your request under the
Freedom of Information Act 2000 (FOIA) dated 5 February 2019 and responded
to on 5 March 2019.

Your original request was:

Please provide copies of documents held by the Council concerning the
following locations in Waterloo Square/Esplanade:

Beach Hotel site

2-4 Waterloo Square

6-8 Waterloo Square

as follows:

1.  Deeds /similar re Council ownership of land occupied by those
properties

2.  Deeds /similar re Council ownership of properties built on such land

3.  Current Leases /similar granted by the Council in respect of such land
and properties

4.  Former leases re such land/properties as existed/were current since
January 2009

Our response on 5 March 2019:

Your request has been considered under the Freedom of Information Act
2000.  Section 21 of the Act confirms that information which is reasonably
accessible to the applicant by other means is exempt information.  The
information you are seeking is available from Land Registry and therefore
the Council is applying this exemption.  You can find out how to conduct a
search from here:

Your email of 26 February 2019:

Please pass this on to the person who conducts Freedom of Information
reviews.

I am writing to request an internal review of Arun District Council's
handling of my FOI request 'Ownership and related lease details of
properties in Waterloo Square, Bognor Regis'.

[Your refusal is based on entirely unsound premises - I asked for copies
of documentation, the Land Registry does NOT have these and so I seek
compliance with what was asked originally, that is copies of stated
documents.   The response is a disgrace.

A full history of my FOI request and all correspondence is available on
the Internet at this address:

Internal Review Response:

I have reviewed the Council’s response to your information request and
apologise for the website you were referred to which was not the official
website of the Land Registry.  The website that should have been
referenced is as follows:

[3]https://www.gov.uk/get-information-about...

The properties you have referred to were registered with the Land Registry
in December 2008. The information you have requested can therefore be
obtained from the Land Registry website (above) using the appropriate link
to the deeds request form.

It is the Council’s view that the information you have requested is exempt
from disclosure under the Freedom of Information Act 2000 because it can
be reasonably obtained from the Land Registry.  Whilst a fee will be
payable to the Land Registry for the information, this does not prevent
the information being reasonably accessible to you for the purposes of
section 21 of the Act.

In an effort to assist your Land Registry search, I have included details
of the property title numbers and the dates their registration was
completed, below:

Beach Hotel site =            WSX324817 –

                                                Completion of Registration
16.12.2008

2-4 Waterloo Square =   WSX324812

                                                Completion of Registration
16.12.2008

                                                WSX324773

                                                Completion of Registration
15.12.2008

6-8 Waterloo Square =   WSX324744

                                                Completion of Registration
12.12.2008

I have now concluded my internal review. If you remain dissatisfied with
the handling of your request or complaint, you will have a right to appeal
to the Information Commissioner at: The Information Commissioner's Office,
Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF (telephone: 0303
123 1113; website [4]www.ico.org.uk).  There is no charge for making an
appeal.
