Dear Her Majesty’s Courts and the Tribunals Service,

Under the FOI Act (2000) please may I request the following:

For the financial year 2016-17:

1. A cost figure for all overtime claimed against the cost centre for HMCTS, Copthall House, 9 The Pavement, Grove Road, Sutton, Surrey, SM1 1DA.

2. A cost figure for all Travel and Subsistence (T&S) claimed against the cost centre for HMCTS, Copthall House, 9 The Pavement, Grove Road, Sutton, Surrey, SM1 1DA.

I would like the total cost figure for each point above broken down into:

• Band E grades (AO-Administrate Officers)
• Band D grades (Executive Officers)
• Band C and B grades (Higher Executive Officers and Senior Executive Officers)

So, in total I am requesting 6 amounts for each grade for each specific reason in points 1 and 2.

If this request exceeds the appropriate limit set out in section 12 of the FOIA then please can I request you offer advice and assistance, under section 16, on how I would get something similar to this request within the limit.

As per your acknowledgement you confirmed that a response would be with me by 25 October 2017. I am yet to receive a response and HMCTS have now failed to comply with the 20 day legislative deadline set out in the FOIA,.

If you are considering the Public Interest Test within one of the exemptions, therefore extending the deadline,e then please can this be explained. Alternative if this is not the reason then please can you explain why this deadline has not been met.

Thank you for your email.

I apologise that the Tribunal has failed to meet the Statutory 20 working day deadline as set out by the Freedom of Information Act 2000. The reason for this is that due to administrative errors your request was only allocated to me on the 19 October 2017, providing me with only 4 working days to locate, extract and collate the information required to answer your request, and unfortunately this was not possible.

I am processing your request and hope to have a response to you shortly.

Again I can only apologise for the delay and any inconvenience caused.

Dear Nikki Gittings ,

I am still awaiting a response regarding my FOI request and it has now been two weeks since your last email, making this request 11 days late over the statutory 20 working day deadline. If this matter is not expatiated with immediate effect and a response issued to me by close on play on 10th November 2017, then I will have no option other than to contact the Information Commissioners Office to step in and assist.
I understand this is not your fault personally but as this request is extremely late with inadequate reasons, it is something HMCTS as a Public Authority should be held accountable for.

I am writing to request an internal review of Her Majesty’s Courts and the Tribunals Service's handling of my FOI request 'Overtime, Travel and Subsistance'.

The reason I request this internal review is relation to part two of my request. You have failed to provide a full breakdown at grade level of the travel and subsistence. You have explained that you do not have access to this level of detail and it is only the local office that do.

Unfortunately all offices of the MOJ/HMCTS are one legal entity under the FOI legislation. This means if they hold this information you are deemed to hold it. Contact with yourselves should have been made to gather this information from the Sutton office so that you can provide it to me.

You have had 20 legislative days to comply with this and have failed on meet both the timeframe and supplying the information.

I wish therefore for you to conduct an internal review on this matter and supply me with the information requested.
