Dear Mr Webber,

I am emailing to provide an update on your recent request for information,
relating to plans for an overnight sitting in the House of Lords in the
week beginning 2 September 2019. We are aware that the statutory deadline
for responding to your request is next Monday (7 October) and we are
working to complete the response by this deadline. The request has
involved a considerable amount of work and it is possible that we may not
be able to meet the deadline. If this looks likely I will contact you on
Monday to keep you informed as to progress.

Please note that we follow the Information Commissioner’s guidance on
calculating the 20^th working day for FOI requests. We are aware that the
WhatDoTheyKnow.com website has calculated the statutory deadline for this
request differently.

Thank you for your patience.

Yours sincerely,

Kimberley Swift

Dear Mr Webber,

Please find attached our response to your request (copied below) to the
House of Lords Administration. Please accept our apologies for the delay
in providing this response.

Section 50 of the Freedom of Information Act 2000 provides that any person
may apply to the Information Commissioner for a decision whether, in any
specified respect, a request for information made by the complainant to a
public authority has been dealt with in accordance with the requirements
of Part I of the Act. In this context you should have regard to the fact
that under section 2(3) the exemption conferred by section 34 is an
absolute exemption and to the terms of section 34(3).

The Freedom of Information Act can be accessed at:

[2][1]http://www.opsi.gov.uk/Acts/acts2000/ukp...

However, if you have a complaint that relates to another aspect of the way
in which your request has been handled then you would, of course, be
entitled to ask the House of Lords to conduct an internal review. This
should be addressed to [2][email address] or to the Freedom of
Information Officer, House of Lords, London SW1A 0PW and explain clearly
the nature of your complaint. Arrangements will be made for someone who
has not been involved in dealing with your request to conduct an internal
review within 20 working days.

If, following this review, you remain dissatisfied with the House’s
treatment of your request for information you may then take your complaint
to the Information Commissioner at Wycliffe House, Water Lane, Wilmslow,
Cheshire, SK9 5AF.

Yours sincerely,
