I am now able to respond to your Freedom of Information request logged on
2nd November under reference 151102024101.

 

... £1.4m outstanding to be collected from developers due to lack of
affordable housing.

 

            What is the plan for the collection of this money?

 

Each of the Affordable Housing Contributions is secured within an
individual Section 106 Agreement.  These are legally binding on the
developer who must pay the financial contributions when the appropriate
trigger within the agreement is met.  For example, contributions could be
paid on commencement of the project, on occupation, or in line with
various phases of development.  These trigger points are monitored by the
Council to ensure payments are made at the agreed time.  Once a trigger
point has been reached, a request for payment is made and in most cases is
met in a timely manner.  Should a payment not be forthcoming the Council
can and will take appropriate legal action.

 

In the case of the sum mentioned the trigger points have not yet been
reached so the agreed contributions are not yet due.

 

            What's the plan for this money once collected?

 

Each Section 106 Agreement will define how the contribution is to be
spent.  Where this is for the provision of Affordable Housing within the
Borough it will be met through whatever means is appropriate, such as
inviting tenders through a competitive system from registered providers of
affordable housing to either enable or enhance any schemes they are
currently working on with a view to securing the greatest possible number
of new Affordable Homes.  This approach can represent a better return on
the contribution where Registered Providers are able to secure additional
units at a much lower price than the Council would be able to purchase
them for on the open market.
