Origins of, and list of 'stock phrases' used when compiling ESA appeal responses.

The request was successful.

Dear Department for Work and Pensions,

Following a mandatory reconsideration by a claimant, if the claimant does not
accept the result of an ESA decision, as one of the steps, the DWP prepares an appeal
response document, and sends it to the tribunal.

Observing many of these, certain common phrases occur more than chance would suggest.
For example “Although X has identified a high level of personal restrictions, she is entitled to CA. To be entitled to CA a person must provide at least 35 hours of care to another person each week. The Tribunal may wish to explore this further.”.

This would lead to the conclusion that such phrases and perhaps their legal justifications are stored in some manner.

Can you please supply the list of such phrases, and any associated justifications (which may include reasoning, caselaw, references to legislation or references to other documents).

Please note, I am not requesting generation of such justification if it is not already stored.

Yours faithfully,

Ian Stirling

Dear DWP Strategy Freedom of Information,

To clarify my earlier request.
"Can you please supply the list of such phrases, and any associated justifications (which may include reasoning, caselaw, references to legislation or references to other documents).

Please note, I am not requesting generation of such justification if it is not already stored."

By this I do not mean by 'associated justifications' general reasoning or other information held by the DWP that is not specifically linked to each phrase. I understand that a search for justification for each phrase, if it is not directly linked in an easily accessible manner would likely breach the statutory limit.

Dear DWP Strategy Freedom of Information,

This response has been considerably delayed.
Can you please respond promptly.

Dear DWP Strategy Freedom of Information,

I apologise for any confusion, but though I cited an example by accident of a PIP stock phrase, the request was for ESA stock phrases. Can these please be supplied.

Many thanks.
