Dear Mr. Bourne,

I refer to your Freedom of Information request of 13 May 2010.

As requested please find attached the documentation in relation to the grant application and the subsequent award with regard the Scala Cinema, Prestatyn, in relation to the Capital and Access Fund.

We are however withholding the personal details (including names of staff, contact telephone numbers and email addresses) under section 40 of the FOI Act. Section 40 applies to the personal data relating to third parties. This is identified by way of the reference A within the documentation.

The public interest in holding the information outweighed the public interest in disclosure because putting such information into the public domain would breach Data Protection Principles 2, Schedule 1 Part II Section 6 in that the data was collected for a specific purpose, and we could not be satisfied that such data would not be processed by the requestor for a different purpose.

In addition, we believe this information was not relevant to the request and was therefore considered to be excessive and disclosure would be likely to cause distress or damage, by making personal details available. Furthermore, third parties and individuals had a reasonable expectation that information would not be released at the time of its provision to us.

Furthermore, Section 43 Exemption applies to all information relating to the financial and contractual structuring of the application/project. This is referenced by the key B within the documentation. The information redacted was:

• Financial information relating to third parties including estimates and quotes
• Full budgets and budget breakdowns
• Specifications specific to the Scala

The public interest in holding the information outweighed the public interest in disclosure because putting such information into the public domain would or would be likely to prejudice the commercial interests of the Scala cinema, any third parties providing estimates/costings and specifications and the UK Film Council, as third parties may raise objections to providing such information to the UK Film Council in future, thus impeding the organisation’s ability to apply due diligence to the allocation of Lottery funding.
