Organogram after 2 August 2017

We're waiting for D. Moore to read recent responses and update the status.

Dear Parliamentary and Health Service Ombudsman,

If you have created an organogram between 2 August 2017 and today, please provide me with a copy (the latest if more than one exists). If you haven't, please provide in written form the information that an organogram would normally contain to show the current organisational structure of the PHSO as of today (or a week or two earlier, if more convenient). Include the names of senior personnel and the number of staff in each section/department etc.

by the Parliamentary and Health Service Ombudsman (PHSO) under the Freedom
of Information Act 2000 (FOIA).  Your exact request was:

The information you have requested is not held.  PHSO is currently going
through a restructure which has not been finalised.

 

If you are unhappy with the way I have handled your information request it
is open to you to request an internal review. You can do this by sending

specify what the nature of the issue is and we can consider the matter
further. Beyond that, it is open to you to complain to the Information

I am writing to request an internal review of Parliamentary and Health Service Ombudsman's handling of my FOI request 'Organogram after 2 August 2017'.

I wrote:

“If you have created an organogram between 2 August 2017 and today, please provide me with a copy (the latest if more than one exists). If you haven't, please provide in written form the information that an organogram would normally contain to show the current organisational structure of the PHSO as of today (or a week or two earlier, if more convenient). Include
the names of senior personnel and the number of staff in each section/department etc.”

You responded:

"The information you have requested is not held. PHSO is currently going through a restructure which has not been finalised."

It appears that you have considered only the first sentence of my request.

It doesn't matter whether the PHSO was going through a restructure at the time of my request; it still comprised personnel performing specific roles. Additionally, I note that you have not specified in your Refusal Notice the FOIA exemption relied on.

a review dated 12^th October 2017 and recent correspondence from the ICO.

Your internal review request:

Internal Review response

 

Timeliness of response:

 

The response to your request was within the 20 working days stipulated by
section 10(1) Freedom of Information Act. However that that you received
no internal review of our response until today is well in excess of the
time the Information Commissioner considers reasonable for providing an
Internal Review.

 

 

Information Provided:

 

I’ve reconsidered your request and our response. I note that the response
at the time was only to the first part of your request and omitted to
provide a response to the second part and as such your request was not
responded to fully. We also failed to provide an Internal Review response.

 

Conclusion

 

For the reasons set out above I uphold your complaint as we did not
provide you with a full response at the time of the request and we failed
to provide you with an Internal Review of that response.

 

PHSO have published a recent organogram since your request and s21 FOI
applies as it is now reasonably accessible via our website

Please accept my apologies for the inconvenience caused by the delay in

Dear InformationRights,

Thank you for providing me the link to a 'recent organogram' published after my request.

If the organogram in question does not reflect the true situation at or shortly before 3 October 2017 (and there is no evidence that it does), then I am not satisfied with your response.

I have been told that no organogram existed at the time of my request, so obviously none could be provided. But I did not simply request an organogram. You have clearly failed to take into account that my request was for information that could or could not have been held in the form of an organogram. That it was not held in the form of an organogram is no satisfactory reason for you not to provide it.

I'll contact the ICO about this matter next month if it is not resoved to my satisfaction.
