Organisational structure charts LD placements

We're waiting for Jen Latham to read a recent response and update the status.

Please provide the organisational structure charts (including names, job title and contact details) for the Children's and Adult's learning disability social care team:
Commissioners, commissioning managers, brokerage managers, head of service, service managers for the LD team and ICB/CCG brokerage.

Section 8(1)(b) of the Freedom of Information Act 2000 states that a request for information must include the requester’s real name.

The ICO guidance states that if the requester:

• fails to provide a name;
• can’t be identified from the name provided (for example because they have only used their first name or initials); or
• is using an obvious pseudonym,

then their request won’t meet the requirements of section 8(1)(b) and will technically be invalid.

Can you therefore resubmit your request and provide me with your full name please?

FREEDOM OF INFORMATION REQUEST FOI001-5472

 

We refer to your email dated 10^th November 2023 which contained a request
for information as set out in italics below.  Following consideration of
your request, in accordance with the Freedom of Information Act 2000, I
respond to each point as follows:

 

Please provide the organisational structure charts (including names, job
title and contact details) for the Children's and Adult's learning
disability social care team:

Commissioners, commissioning managers, brokerage managers, head of
service, service managers for the LD team and ICB/CCG brokerage.

 

Please find attached the Structure Charts requested. Whilst we can confirm
that we hold the information requested regarding staff members below
Corporate Director level, we consider that this information is exempt
under section 40(2) of the Freedom of Information Act 2000 which states:

 

(2) Any information to which a request for information relates is also
exempt information if—

(a)it constitutes personal data which does not fall within subsection (1),
and

(b) the first, second or third condition below is satisfied.

(3A)The first condition is that the disclosure of the information to a
member of the public otherwise than under this Act—

(a)would contravene any of the data protection principles,

 

Disclosure of the names of individual staff members would breach the first
data protection principle as set out in Article 5 of the General Data
Protection Regulation which states:

 

 1. Personal data shall be

 

 a.       Processed lawfully, fairly and in a transparent manner in
relation to the data subject (‘lawfulness, fairness and
transparency^2);

 

Article 4 of the General Data Protection Regulation states that:-

 

For the purposes of this Regulation: (1) ‘personal data’ means any
information relating to an identified or identifiable natural person
(‘data subject’); an identifiable natural person is one who can be
identified, directly or indirectly, in particular by reference to an
identifier such as a name, an identification number, location data, an
online identifier or to one or more factors specific to the physical,
physiological, genetic, mental, economic, cultural or social identity of
that natural person;

 

The Information Commissioner’s guidance “Access to Information about
public authorities’ employees” and “When should names be disclosed”
provide guidance on how the Authority should treat requests for
information of this nature. The Authority considers the information
requested to be absolutely exempt from disclosure by virtue of Section
40(2) of the Freedom of Information Act 2000.

 

The Authority does not consider that it would be fair in all the
circumstances to identify the individual as whilst the information relates
to them in their professional capacity, they would not reasonably expect
their details to be placed into the public domain. The Authority’s
procedure is not to disclose as a matter of routine information about
members of staff below Corporate Director level.

 

I hope this response satisfies your request. If you are dissatisfied with
the handling of the request, under the Freedom of Information Act 2000 you
have the right to request a review of the Council’s response to your
request for information.  If you wish to request a review, please write to
