Request for information under the Freedom of Information Act
Thank you for your email received 24 August 2019 requesting information regarding
organisational structure charts.
Please find detailed below a summary of your request, together with our response.
Summary of your original request:
Please can you provide under the Freedom of Information Act a full management structure
chart for the Trust inclusive of all 'Heads of Service,' 'Assistant Directors' and Directors
with the full job titles and the names of individuals who hold these positions.
Please find detailed below structure charts as requested. The Trust responded to a Freedom of
Information request asking for clinical structure charts in July 2019 which is available on our
website.

Structure-Charts.pdf Therefore some of the information you requested is exempt from disclosure under section 21 of
the Freedom of Information Act 2000 ‘information accessible to applicant by other means’. I have
detailed below the relevant excerpt from the Act:
Section 21 - Information accessible to applicant by other means.
(1)
Information which is reasonably accessible to the applicant otherwise than under section 1 is
exempt information.
(2)
For the purposes of subsection (1)—
(a)
information may be reasonably accessible to the applicant even though it is accessible only on
payment, and
(b)
information is to be taken to be reasonably accessible to the applicant if it is information which
the public authority or any other person is obliged by or under any enactment to communicate
(otherwise than by making the information available for inspection) to members of the public on request,
whether free of charge or on payment.
(3)
For the purposes of subsection (1), information which is held by a public authority and does not
fall within subsection (2)(b) is not to be regarded as reasonably accessible to the applicant merely
because the information is available from the public authority itself on request, unless the information is
made available in accordance with the authority’s publication scheme and any payment required is
specified in, or determined in accordance with, the scheme.
It is Trust policy to not release names and contact details of staff below Executive Director Level
as this constitutes personal information which is exempt under Section 40(2) in conjunction with
Section 40(3A)(a) of the Freedom of Information Act 2000 which relates to ‘Personal Information’.
An excerpt of the relevant Freedom of Information legislation can be found below:
Section 40 – Personal information
(2) Any information to which a request for information relates is also exempt information if—
(a) it constitutes personal data which does not fall within subsection (1), and
(b) either the first, second or third condition below is satisfied.
(3a) The first condition is that the disclosure of the information to a member of the public
otherwise than under this Act
(a)
would contravene any of the data protection principles, or
(b)
would do so if the exemptions in section 24(1) of the Data Protection Act 2018 (manual
unstructured data held by public authorities) were disregarded.
If you are dissatisfied with the handling of your request, you have the right to ask for an internal
review. Internal review requests should be submitted within two months of the date of receipt of
the response to your original letter and should be addressed to:
