In response to your request for information received at this office on 05
July 2022, please see the Council’s response below.

You requested

Please provide the organisational structure charts (including names, job
tile and contact details) for the Education/Childrens directorate covering
the following job titles:

Director, assistant director, Head of Service, Service Manager.

Our response

Please find attached structure. Please note that we only supply names for
senior staff only i.e. Heads of Service upwards. Information on staff
below this level is being withheld under Section 40(2) of the Freedom of
Information Act 2000.

 

The first data protection principle in Article 5 of the GDPR states that
personal data must be ‘processed lawfully, fairly and in a transparent
manner in relation to individuals’. If disclosure of any personal data
would breach this principle, that information is exempt from such a
disclosure under section 40(2) of the Act. The ICO  (Information
Commissioners Office) advises that public authorities must consider the
consequences of disclosing information under the Act, to the world at
large, and not just the impact of providing the material to a particular
requester.

In this case, we believe that senior staff have an expectation that their
names will be in the public domain. However, in the case of less senior
staff, this is not the case. We therefore believe that the disclosure of
the names of Service Managers without their consent would be unfair, the
council has therefore considered that release of this information would
constitute a breach of this first principle and therefore the information
is exemption from disclosure. As such, the application of Section 40(2)
can be justified. In accordance with the Act, this email constitutes a
Refusal Notice for this part of your request.
