Dear Mr Marsden,

Thank you for your request for information regarding organisational
charts for employees who are either managerial level or above; please
find our response attached. Please accept my apologies for the delay in
responding to you. If you have any queries regarding this request for
information then please don't hesitate to contact me.

Please note the names of managers are exempt information under both the
Freedom of Information Act 2000 and the Data Protection Act 1998. I have
deemed it reasonable to name individuals in their professional capacity
for officers who are Strategic Heads of Service or senior.

If we included the data individuals would be identified, therefore we
have exempted this information under Section 40 (1) and (2)(a) of the
Freedom of Information Act which states:

'Any information to which a request for information relates is exempt
information if it constitutes personal data of which the applicant is
the data subject '. (1) and

'It constitutes personal data which does not fall within section (1)
above but is covered by the Data Protection Act 1998'

Part IV of the Data Protection Act 1998 states that releasing personal
data to anyone other than the data subject is unlawful.

The sixth principle of the Data Protection Act 1998 states that
'personal data shall be processed in accordance with the rights of data
subjects under this Act'. Releasing the information would not be in
accordance with the rights of the individuals concerned.

Releasing the data would enable individuals to be recognised. This makes
the data 'personal data' as defined within the Data Protection Act and
therefore exempt under the Freedom of Information Act as described
above. The Data Protection Act allows access only to those who are
classed as the data subject. In this case the information is exempt
under the Data Protection Act also as you are not the data subject.

If you are unhappy with the service you have received in relation to
your request and wish to make a complaint or request a review of our
