I am writing to confirm that the Council has now completed its search for
the information which you requested on 02 Nov 2017 about Freedom of
Information request - ORG Structure Chart.

The information supplied has been provided by the department responsible
for the service delivery. Please see below;

A; I will be sending you the Special Educational Needs department
sturcture chart shortly by email as our FOI system does not support
attachments.

However with regard to your information request for their names, the
Council considers that disclosing this information may lead to the
identification of the individuals, so as to amount to ‘personal data’
under the Data Protection Act 1998. See Exemption: Section 40(2) FOIA
below. However, in-line with the ICO guidance, we are able to provide the
names for heads of service. Please see council website:

(Section 40(2) of FOIA provides that wherever an application for personal
data is made by someone other than the data subject, the information to
which it relates is exempt from disclosure under the Act where to do so
would contravene one of the data protection principles or the right to
prevent processing likely to cause damage or distress.

The first data protection principle under Schedule 1 of the DPA is that
“personal data shall be processed fairly and lawfully and in particular,
shall not be processed unless at least one of the conditions in Schedule 2
is met.” In particular, what is fair and lawful focuses upon what the
reasonable expectation of a person would be in relation to how their
information is used and to whom it may be disclosed.

 Schedule 2 lists the conditions to be met and the one which is most
relevant to the facts of this case is found at Part 6(1) and is applicable
where:

“The processing is necessary for the purposes of legitimate interests
pursued by the data controller or by the third party or parties to whom
the data are disclosed, except where the processing is unwarranted in any
particular case by reason of prejudice to the rights and freedoms or
legitimate interests of the data subject.”

Your interests in the personal data being disclosed must therefore be
balanced against the interests of the ‘data subject’ in the information
not being disclosed. There is no presumption in favour of disclosure of
personal data under the FOIA. My view is that the data subject has a
legitimate interest that their personal data will remain private and would
potentially cause harm to the individuals if disclosed into the public
domain.

The disclosure would be unwarranted and contrary to the first data
protection principle. As the data subject has no expectation of public
disclosure, for these reasons, disclosure will not be fair and lawful.

While I clearly recognise a strong public interest in favour of openness
and transparency by the Council, this does not override other
considerations as mentioned above, in particular the expectation of
privacy by the data subjects and the need to avoid causing damage or
distress to individuals in making the disclosure).

The information supplied to you continues to be protected by the
