Oral Health Strategy Consultation, 2016, Durham County Council

Dear Durham County Council,

Between 1st August 2016 and 5th October 2016, Durham County Council went out to consultation to the public and to special interest groups with the aim of establishing its oral health strategy.

The results of the consultation are apparently not in the public domain.

1. Please provide a scanned copy of the Oral Health Strategy consultation document and questionnaire.
2. Was the consultation advertised in the local press or radio? If so, please neame the newspapers and radio stations.
3. How did members of the general public come to hear about the consultation if the answer to (2) is "no"?
4. How many members of the general public responded?
5. If the consultation was not intended for the general public, how many members of the public belonging perhaps to Special Interest Groups, were invited to respond?
6. Were there any selected members of the lay public who were invited and who were not included in (4) and (5) and how many responded?
7. How many dental health professionals were invited and how many responded ?
8. How many employees of PHE were invited and how many responded?
9. How many people in the Children and Families Partnership were invited and how many responded?
10. How many people n the CYP Overview and Scrutiny Committee were invited and how many responded?
11. How many people in the AWH Overview and Scrutiny Committee were invited and how many responded?
12. How many people responded who attended the Big Tent Event on 5th October 2016?
13. What was the total number of responders?
14. Please provide a summary of the results. For this I would like to see how many people were in favour of or against each oral health intervention discussed in the consultation document.
14a. As a sub-set of Item 14, how many members of the public (Questions 4,5 and 6) were in favour of, or against each oral health intervention discussed in the consultation document
15. Please provide the itemised conclusion which was used to form the basis of the current oral health strategy.

Depending on the type of request, it will be handled under the Freedom of Information Act (FOIA) or the Environmental Information Regulations (EIR). Both of these have a statutory 20 working day deadline for a response however, in some cases, the deadline may be extended to 40 working days. The deadline for an FOIA request can be extended if an extended public interest test is required before deciding to respond. The deadline for an EIR request can be extended if the information requested is too voluminous or complex to respond to fully within the 20 day timescale. If this is the case, we will write to explain that to you.

If we hold this information, we will let you know and in most cases supply it to you. You may request a particular format for receiving the information and we will do our best to accommodate. In most cases, we will respond by email or letter in 12 point Arial font. If you have a particular need to receive the material in a different format, please let us know.

In some cases, the information you request will be exempt from disclosure. What this means is that the legislation allows the Council to refuse to provide the information. Where this occurs, we will tell you the reasons why and we will explain how to appeal that decision.

If your requests refers to a third party, then they may be consulted about disclosing the information before we decide whether to release the information to you. For example, if someone asks about a contract with a supplier, we will contact the supplier to consider their views about disclosing the information.

NB: There may be a charge for environmental information. Please contact us if you have any questions about that charge.

In some cases, we may require a payment to cover photocopying, postage, or other production costs on requests that require large amounts of photocopying. However, we will discuss this with you and look for ways to provide the information in electronic formats if possible. If a payment is required, it must be provided before we can send you the information. If a payment is required, the 20 working day time limit for responses is suspended until the payment is received.

We may also need to contact you to clarify your request. We are obliged to do this under s.16 of the Act, which refers to the duty to provide advice and assistance to applicants. When we ask to clarify your request, the 20 working day countdown stops until we hear back from you. If you have not contacted us about the request within 30 days, we will close it.

Please note that your request and our response will be put on the Council’s disclosure log. What this means is that we keep a log of all the requests and responses if anyone wants to look at them. When we put the request and response on the log, we remove the applicant’s name and any personal references. In any case, where personal information remains, it will be done in accordance with the Data Protection Act (DPA).

Dear Freedom of Information,

I am asking for information which was collected in 2016. I cannot see how it is not available in 2018. Please provide me with the information which I've requested without further delay.

Clearly, if you do not comply with this request then I have the right to request an internal review which would not find in your favour since if the public consultation took place, then the questions asked of the public plus their responses are available now, two years later.

It looks as though you are deliberately delaying replying to my request. Therefore, you are not compliant with the provisions of the Freedom of Information Act. Does this mean that you are breaking the law?

However, it could be that a public consultation never took place and I would appreciate you informing me that this is or is not the case. That is, were as the public ever consulted regarding your oral health plans for the County of Durham?
