Opting out of secondary processing of uploaded data by the HHR

Dear Portsmouth Hospitals NHS Trust,

Thank you for all your previous responses.

I would like to make a further request about your involvement with the Hampshire Health Record under the FOI Act.

For the purposes of the Act, please take the date of your receipt of this request as 15th April 2016.

I had made a request for information to NHS South, Central & West CSU (the data controller for the HHR), via NHS England. However, NHS England & the CSU claimed to not hold this information, an assertion that I have obviously challenged (as they must hold it).

I have little confidence in NHS England's capacity to respond lawfully, or in a timely fashion, to FOI requests, and since the HHR data controller (the CSU) will not provide me with this information it seems prudent to obtain the information that I seek from the individual organisations that are uploading information to the HHR database. For sure you know what you have permitted to happen to the data that you upload.

My request is simple and straightforward.

I note with interest that Hampshire Hospitals NHS FT, an organisation (like yours) uploading to the HHR, has not permitted information derived from its records to be used for secondary purposes (that is, for purposes other that direct medical care) by the HHR (or HHR analytics).

I would like to know whether your organisation has taken that approach as well.

• Could you kindly tell me whether your organisation has opted out of making your uploaded data available for secondary uses such as the analytics database, just like HHNHSFT.

If not, and you do allow the HHR to process information that you have ectracted and uploaded for both primary (direct medical care) and secondary purposes, then please could you provide me with the following:

• The process by which patients may express to you their wish for information that you hold about them to be uploaded to the HHR for primary purposes *only*, or indeed whether such a wish cannot be respected and it is "all or nothing" with your organisation

I would be grateful if you would be kind enough to send me the requested information promptly and in any event not later than the twentieth working day following the date of receipt of my request.

I would be grateful if you would kindly acknowledge receipt of this request as recommended by the ICO ("It would be good practice to acknowledge receipt of requests and to refer to the 20 working day time limit, so that applicants know their request is being dealt with").

Request for information under the Freedom of Information Act 2000

 

Thank you for your request, made under the Freedom of Information Act 2000
(the Act) which was received by Portsmouth Hospitals NHS Trust on  15
April 2016.

 

Under the terms of the Act we expect to respond to this request in 20
working days. However, we will also investigate the nature of the
information requested. If clarification is required in order to identify
the information requested then the response period will be suspended until
such time as we receive clarification.

 

Please note that in accordance with section 12(4) of the Act where
multiple requests for information are received from one person or by
different persons who appear to be acting in together in a single campaign
the estimated cost of complying with any of the requests is to be taken to
be the estimated total cost of complying with all of them. Where
applicable, we may deal with multiple requests for information under a
single reference.

 

There are also a number of exemptions which the Act permits with respect
to disclosure of information. The information will be assessed for these
exemptions prior to us releasing the information to you. We will advise
you if we are unable to provide the information requested due to
exemption(s).

The supply of information under Freedom of Information is intended to be
for personal use only and does not automatically give the recipient the

make it available to a wider audience [SI 2005 No: 1515 4(1)]. 

 

The Trust provides information under the Freedom of Information Act in
line with the template [1]Open Government Licence for public sector
information. Should you wish to re-use any information in line with this
Licence then you are not required to take any further action.

 

The Open Government Licence allows you to re-use information freely and
flexibly, with only a few conditions. If you wish to re-use information
outside of the Licence terms then please inform the Trust as unauthorised
