Dear Driver and Vehicle Licensing Agency, I would like to opt of you sharing my information with any third parties
Dear Mr Cuthbertson,
Thank you for your email of the 11 June, to the Freedom of Information (FOI) email address, about the release of information from the DVLA’s vehicle records. Your request is being answered under business usual and not under FOI Act 2000.
The DVLA takes the protection and security of the information it holds very seriously and has robust procedures in place to ensure that all data sharing activities comply with data protection law.
Regulation 27 of Road Vehicles (Registration and Licensing) Regulations 2002 allows vehicle keeper details to be disclosed to third parties who can demonstrate that they have a reasonable cause to receive it. This Regulation provides a legal gateway for the release of information and does not require the consent of the data subject. Guidance on what constitutes reasonable cause is published online at www.gov.uk/request-information-from-dvla
DVLA is very open and transparent, proactively setting out how it manages and shares data for a range of important functions including road safety, collection of duty for the Exchequer and for law enforcement. Again, this information is published at: https://www.gov.uk/government/publicatio....
In keeping with our responsibility to properly manage information vital to so many functions in the public interest, we will continue to share data with law enforcement agencies, government departments and other third parties where the law provides for it and with appropriate controls in place in line with the new rules.
The most recent audit by the ICO judged the DVLA’s procedures to offer high assurance that processes to mitigate the risks of non-compliance with the DPA are in place.
