Dear Department for Work and Pensions,

Please can you provide me with the operational guidance on claiming NI Credits. This guidance is mentioned in DMG Chapter 02 paragraph 02002.

Dear Operations FOI Requests,

I am writing with regard to my FoI request made on 14/01/2018. Your reference is 170.

I have received the guidance relating to those claiming credits who were entitled to JSA, but didn't want to claim that benefit, as well as a couple of other types of credits.

However I would really like the guidance concerning NI Credits given to people who are not receiving ESA, but are entitled to credits because of their limited capability for work (Reg. 8b(2)(iv) of the credits regs).

In particular, I want the guidance concerning someone not entitled to IR-ESA because of their partner's income, nor to CB-ESA because they haven't paid enough NI, but who can still claim NI Credits.

Yours sincerely,

Charles Ellinson

Dear Operations FOI Requests,

I am writing again with regard to my FoI request submitted on 14/1/2018 (your ref: 170).

After receiving your reply, I replied on 25/1/2018 saying that the supplied information did not fully cover what I had requested (this is marked as your ref: 364).

Your reply to this unfortunately did not contain any relevant information. The original reply had contained relevant information (but just didn't include everything I had requested), however the second reply contained two attachments, one of which has absolutely no relevance, and the second mentioned awards of NI Credits in one passing sentence.

So, again, could I please have all operational guidance with regard to claimants entitled only to NI Credits. And, again, I would like the guidance for other types of credits, not just JSA 'non-claimants' (which was supplied in the original response). This would include claimants not entitled to either type of ESA (who can still get NI Credits).

Yours sincerely,

Charles Ellinson
