Operational guidance for implementing policy of response to Freedom of Information Requests (Hydraulic Fracturing and Unconventional Gas operations)

Dear Health and Safety Executive,

I refer to the following document available at http://www.hse.gov.uk/foi/foiprocedures....

and its relation to all or any Freedom of Information requests made to HSE relating to all or any current or future operations and operators/and policies of the Energy Industry and Unconventional Gas (UG) companies
( where UG is coal bed methane, shale oil or gas, extracted by hydraulic fracturing or underground coal gassification, UCG.)

in exploration and /or extraction phases.

1) Please provide details of correspondence between the 'Policy Unit' from the Legal advisers office (LAO) where advice has been sought about the handling of queries relating to UG and associated queries-as outlined above.
Please indicate the dates and outcome of the correspondences.

2) Staff training
i) Please provide the dates of training given to FOI Officers and Decision Makers to cover any updates to the handling of FOI requests relating to queries about UG and associated queries -as outlined above
ii) together with a summary of the information received.
iii) Please provide emails to staff outlining expected practices and any changes.

3) Exemptions and partial disclosures

Previous FOI responses from HSE have stated

'Disclosure would inhibit HSE’s ability to conduct investigations
effectively as duty holders would be less willing to volunteer information
with the level of detail they currently provide to HSE if information is
disclosed inappropriately;

· Disclosure could weaken our position with the wider public
concerning this highly sensitive subject and the usefulness of such
sensitive information to its competitors.'

i) Please define 'disclosed inappropriately' and whom determines 'inappropriate'.
ii) Please explain why the HSE deems it is in a role to protect the commercial interests of an operator as stated is its response :
'and the usefulness of such sensitive information to its competitors.'
iii) Please provide specific guidance and documents to support the permissible reasons to refuse information on grounds of 'adverse effects' to Commercial confidentiality, together with guidance on how you establish the 'causal link' to establish prejudice under the Freedom of Information Act.

Please provide the dates of recent updates to this advice.

iv) Please provide your guidance to FOI Officers and Decision Makers on what may be deemed 'manifestly unreasonable'.

4) In the event of an ongoing investigation,e.g. exemption 12 (5) (b) Course of Justice please state what time period your FOI officers are advised to allow to lapse before a resubmitted FOI may be dealt with, together with your policy documents to support this.
