Dear South Yorkshire Police,

I am writing to request an internal review of South Yorkshire Police's handling of my FOI request 'Operation Turkey'.

It is noticeable in other WDTK requests lodged to your department weeks after the date this specific request was submitted, have been processed (example, https://www.whatdotheyknow.com/details/r...).

The Act requires a public authority to respond PROMPTLY and, in any event, within 20 working days. As such, there is a breach of section 10 and 17 of the Act.

Good afternoon        

I’m sorry we have not been able to respond to your FOI Request on time.

Unfortunately, currently SYP is dealing with extended staffing issues, as
well as with an increased amount of requests, which have contributed to a
large backlog.

Please note we are doing everything we can to clear the backlog but with
continuing staffing issues we will have further ongoing delays. 

Please note we are working on our requests in date order to ensure
fairness for all applicants.  The Information Commissioner’s Office is
aware of the issues we are dealing with and the steps we are taking to
address this. 

It would also be a tremendous help if you could let us know if your  FOI
is still required, if we will not hear back from you  in two weeks we will
close your current request. Please note that we are taking this step due
to difficult situation we are in to aid applicants who are still looking
forward to receive the responses. If you prefer to keep your request open,
please make sure to contact us within the 2 weeks from our notice.

Dear South Yorkshire Police,

"Please note we are working on our requests in date order to ensure fairness for all applicants. It would also be a tremendous help if you could let us know if your FOI is still required, if we will not hear back from you in two weeks we will close your current request."

It is very noticeable in browsing your office's responses to other WDTK requests received at your department weeks after the date my specific request was submitted that delivery within Section 10 of the Act has been respected for other people such as Laura Ridsdale's reply on 23rd February (https://www.whatdotheyknow.com/details/r...). This thereby suggests your office is in fact stemming responses to some requests but not others and is mistreating some under the guise of an on-the-face-of-it reasonable date-ordering your office claims to have implemented to ensure fairness in response to internal utilisation and staffing issues. This cannot stand while your office jumps the queue for others, but not for example mine. Your quota of fairness to my request is long overdue to be cashed-in and I would appreciate your office complies.

Again, I am writing to resubmit my request dated 1st April for an internal review under Section 45 of the Act, about South Yorkshire Police's handling of my FOI request 'Operation Turkey' submitted 22nd December 2022, due to your office's failure to issue an outcome to my request in statutory time frames per Section 10 of the Act. There is a breach in this instance to Section 10, 17 and it seems 45 too as of 1st April. Evidence will be provided to the ICO that your office has created guise of resource utilisation and capacity issues to mistreat responding to some WDTK requests and is also asking unnecessary questions as another component of unreasonable delay.

Attention is further invited to the College of Policing's Authorised Professional Practice (APP) on internal reviews. APP is enshrined in law by way of the Code of Ethics at Section 39A of the Police Act, 1996 (https://www.app.college.police.uk/app-co...).
