Information Commissioner's Office

10 August 2017

Case Reference Number IRQ0691105

Dear Mr Hastings

Request for Information

Thank you for your information request to the Information Commissioner’s
Office (ICO) of 15 July 2017, in which you asked:

“I wish to see full report of the' Operation Motorman' investigation.

https://en.wikipedia.org/wiki/Operation_...

We have dealt with your request in accordance with your ‘right to know’
under section 1(1) of the Freedom of Information Act 2000 (FOIA), which
entitles you to be provided with any information ‘held’ by a public
authority, unless an appropriate exemption applies.

We can confirm that the ICO produced two reports relating to Operation
Motorman, ‘What Price Privacy?’ and ‘What Price Privacy Now?’.  These were
both submitted by the ICO to Parliament and were published on 10 May 2006
and 13 December 2006.

Both reports were published on the ICO’s website at the time, but they no
longer appear on our current website.  Although we still hold copies of
these two reports, they are also still available via the archive ICO
website held by The National Archives (TNA).  Links to both reports can be
accessed via the TNA website here:

[1]http://webarchive.nationalarchives.gov.u...

We would mention that as the information you have requested is already
reasonably accessible to you via the internet the exemption under section
21 of the FOIA is applicable, which states “Information which is
reasonably accessible to the applicant otherwise than under section 1 is
exempt information”.  This means that the ICO is not required to
communicate the information to you, or provide you with a copy of that
information.

By way of advice and assistance you may also be interested in the section
of the Leveson Inquiry Report that relates to Operation Motorman.  This
can be found in Volume III, Part H of the report, from page 999.  This is
also available via the TNA archive of the Leveson Inquiry website, now
available here:

[2]http://webarchive.nationalarchives.gov.u...

The ICO also published our response to the Leveson Report, which is still
available on our current website here:

[3]https://ico.org.uk/media/about-the-ico/c...

We hope this is helpful, but if you are dissatisfied with this response
and wish to request a review of our decision or make a complaint about how
your request has been handled you should write to the Information Access
Team at the address below or email [4][ICO request email].

Your request for internal review should be submitted to us within 40
working days of receipt by you of this response.  Any such request
received after this time will only be considered at the discretion of the
Commissioner.

If having exhausted the review process you are not content that your
request or review has been dealt with correctly, you have a further right
of appeal to this office in our capacity as the statutory complaint
handler under the legislation.  To make such an application, please write
to our Customer Contact Team at the address given or visit our website if
you wish to make a complaint under either the Freedom of Information Act
or Environmental Information Regulations.

A copy of our review procedure can be accessed from our website [5]here.

Yours sincerely
