Operation Gleam will not cost my council any money?
Dear Powys County Council,
Further to your comments in answer to my previous questions i note that the Solicitr to the council has stated in regard to Operation Gleam that
"explaining that all costs incurred would be refunded to the Authority".
To be clear, is it true that Operation Gleam will not cost us Powys tax payers any money?
Is this the truth?
We need to be told. i suspect him to be a lying and i would be gratfeul if he can confirm his assertion or withdraw his bold deceit.

Operation Gleam Costs
The above is a summary of your request. The full details of the
information sought is provided to the officer to whom the request is
tasked.
Your request will now be considered and you will receive a response within
the statutory timescale of 20 working days as defined by the Act, subject
to the information not being exempt or containing a reference to a third
party. In some circumstances Powys County Council may be unable to achieve
this deadline. If this is likely you will be informed and given a revised
time-scale at the earliest opportunity.
There may be a fee payable for the retrieval, collation and provision of
the information you request. If this is the case you will be informed and
the 20 working day timescale will be suspended until we receive payment
from you. If you choose not to make a payment then your request will
remain unanswered.
Some requests may also require either full or partial transference to
another public authority in order to answer your query in the fullest
possible way. Again, you will be informed if this is the case.
The due date for responding to this request for information is 26/02/18.

This is to inform you that your request has been considered and I can
provide the following response:
The Request:

The Response
Your use of intemperate language is regrettable.
As we have advised the requestor on a number of previous occasions the
information surrounding costs is already in the public domain. The
purpose behind the Freedom of Information is to allow the public access
(unless and exemption applies) to information that is recorded by the
public authority. It is not to pass opinion or judgement unless that is
recorded. Neither is it to respond to questions posed, again unless any
response is deemed to be recorded information.
We have no recorded information to respond to your request, although I am
assured by the Solicitor to the Council that in providing a response to
previous FOI Request numbers F2017-0374/0701/0702 &0725 he has not lied
nor been deceitful as alleged.
We do not propose to answer any further questions on this matter as we
consider that the matter has been discussed on a number of previous
occasions and that the requests are becoming vexatious, in both repetition
and language used.
We believe that this request is now complete and shall be closed
immediately.

Dear Powys County Council,
Please pass this on to the person who conducts Freedom of Information reviews.
I am writing to request an internal review of Powys County Council's handling of my FOI request 'Operation Gleam will not cost my council any money?'.
I requested an explantion of whether Operation Gleam will cost Powys tax payers money. The Solicitor to the council has stated that it will not cost the tax any money.
I the minutes provided by the response in a council meeting it was noted that there was a possibility that the funds for costs may not be recovered.
These two bits of information seem to be at odds.
How can the solicitor be convinced that all costs will be recovered when there on council minutes record that there is a possibilty that costs will not be recovered.
These costs are approaching £1 milliionand are still ongoing.
Could we see what informatio the solicitor to the council relies on to reach his unshakabel conclusion that he will get the money reimburshed?

We acknowledge receipt of your complaint regarding the Information relating to " Operation Gleam Costs". We regret that you have expressed dissatisfaction in the service provided by Powys County Council in respect of your recent request for information. Your complaint will be referred to the most appropriate individual for review, in accordance with the Council’s Freedom of Information Complaints Policy.
Powys County Council attempts to respond to requests for a review within 20 working days, however, this is not possible in all cases. We will endeavour to respond by 28/05/18.

the solicitor to the council appears to be lying.
My question how much will Operation Gleam cost the council ?
Has the simple answer around £400 000 and rising as the legal case invloved with the recovery of the money is still ongoing.
The answer given initailly was that Operation Gleam will not cost the council any money as all the money spent will be recovered.
This first answer appears to be untrue.
