Dear Wirral Metropolitan Borough Council,

For clarification this particular FOI request relates to reimbursement of monies that should be repaid to disabled people is in ADDITION to previous issues of unlawful charging (hence the title of this request - which relates to an email sent by a social services manager in a previous cover up).

This FOI request is in relation to unlawful charging of disabled tenants supported by an external organisation (Service Provider 3) and sanctioned by social services managers described by AKA in the Independent Review report (January 2012) as “serious as there is some potential, if they are proven, for further reimbursement to be made ...... Members must ensure they keep track of the progress in resolving them once and for all.” There is no evidence to suggest that elected members have kept track of progress resulting in an unacceptable delay in resolving this issue “once and for all” .

I have pursued this matter to no avail since the publication of the Independent Review even assisting Wirral Council by providing information to circumvent an £8 million legal claim against them.

As far as I’m concerned the information that Wirral Council holds and which I have provided proves that the case for a reimbursement is beyond dispute and the act of hiding behind “legal privilege” to deny a reimbursement is unethical and brings Wirral Council into (further) disrepute. This issue was one of maladministration on the part of Wirral Council and accordingly I believe there should be a reimbursement process similar to that of West Wirral/Balls Rd tenants who were also subject to unlawful charging.

I am concerned that I was informed in September 2012 that a consultant (Robert Vickers) “has been brought in to look at this AKA Recommendation in particular” .
It is now October 2014.

Therefore:
a) I would like to request in accordance with Freedom of Information Act exactly how much that Robert Vickers and /or Robert Vickers Social Care Consultancy Ltd has been paid has been paid in consultancy fees from his appointment as an external investigator of the “4 week delay” case up until his current role.
b) I am requesting that Wirral Council outline the process of reimbursement they intend to undertake in relation to this complaint.

I requested this information in a complaint as an FOI request addressed to Wirral Council Chief Executive Graham Burgess on 15th September 2014.
I have not received the information and am therefore compelled to pursue the matter further.

text below which is Council’s response to your request for an Internal

Response to question a)

Payment made to Artleboot Ltd. for work commissioned from Rob Vickers
(including ‘4 week delay’ case) was £6,624.96

Payment to SWIIS UK Lts (via Matrix) for position as Interim Head of
Branch up unto March 31^st 2014 when Mr. Vickers left

was £172,136.92

 

Response to question b)

The situation has been considered relating to the group referred to in the
complaint.  A review of circumstances relating to former residents of SIL
was commissioned by the Director of Adult Social Services from an
experienced Senior Manager in DASS with legal support.

 

This was undertaken both in response to an AKA recommendation and in
response to provider claims.  The review concludes that there is no
evidence that individuals have not had support that they are entitled to
nor have they suffered any financial disadvantage as a result of the
Councils actions, there is therefore no requirement for a reimbursement
process.
