Dear Leeds City Council,

It was a number of years since the demolition of the Pavilion was carried out yet there was an unbilled outstanding amount of £28,000.00 as recently as March 2018, details are as follows.

The following is quoted from the Accounts and A.G.M. on 27th February 2018 - Leeds Schools' Sports Association, which is available on the Charity Commission Website.

'the threat of a bill from L.C.C. of £28000 for demolishing the pavilion on the site on Oldfield Lane. We are still disputing this.'

1. What was the nature of the dispute, mentioned by L.S.S.A. within their returned accounts as quoted above which lead to £28,000.00 remaining unbilled in 2018?

Due to the complex nature of your request and relevant members of staff

The sum of £26,303.52 was registered as a local land charge on 27th
September 2005. The sum relates to the costs incurred by the Council to
demolish the former pavilion building at Oldfield Lane. A search of the
Local Land Charges Register undertaken on 12th September 2019 confirms
that the charge is still registered. The charge sits with Building Control
and no information is held by them regarding a dispute. All records
relating to this, if there are any, would be in archive given the date of
the charge.

to make representations to us if it appears that we have failed to comply
with a requirement of the Regulations in relation to your request.

I have fully reviewed your case in accordance with stage 2 of the Council’s complaint’s policy and now provide the following response.

Can you please clarify the response to Q2 - What was the total cost to Leeds City Council for the demolition of the Pavillion?
We confirmed in our previous response that the sum of £26,303.52 was registered as a local land charge on 27th September 2005. Unfortunately we don't hold any further information electronically. In order for us to confirm further detail in this respect we need to access our archive facility. Information from 2005 is held in paper records and any records from this period have been archived some years ago. Unfortunately due to the current Covid crisis we are unable to access any archive boxes to establish if any information is held in this respect. If you are still interested in this once we have confirmation from the Government that we can move about freely, please contact us again.

I just read this extract from the ICO and wanted to ask if you’re sure this doesn’t apply to my request, since Leeds City Council are still the holder of the Local Land Charges register, for an electronic copy of the requested documents?

Document title = The Information Commissioner’s response to the Land Registry’s consultation on Local Land Charges Rules 2017 (‘the consultation’)

Extracted Paragraph - Rule 12 (4) refers to a prescribed fee to access such documentation. Under the EIR, charging is permissible in certain cases. However any charge should be ‘reasonable’ – it should not exceed the costs you incur in making the information available or act as a deterrent to the right to request information. As Rule 12 (5) suggests that copies of documentation requested will be in electronic format, and therefore unlikely to incur photocopying and postage costs, Land Registry must satisfy themselves that the any fee charged is justifiable and consistent with the terms of the EIR.

With reference to questions 2 and 3.

 

The requested records from this time period were not scanned and are
therefore likely only to exist as hard-copies at our archive facility.

 

As previously stated and unfortunately at this current time officers are
unable to carry out the necessary searches of the requested records at our
archive facility due to the impact of COVID-19, lockdown and the diversion
of resources across the council and this will remain the case until normal
working practices resume.  However, please note that we cannot actually
guarantee that this file still exists, due to its age, but we have been
advised that officers will check the list of retained files as soon as
practically possible and we will do our best to find out if the requested
information is still available.

 

I am sorry for any inconvenience this may cause. However, once normal
working practices are reconvened I will endeavour to supply or notify you
the result of the required searches as soon as practically possible.

 

I trust that this response is satisfactory. Under Regulation 11, however,
you are entitled to make representations to us if it appears that we have
failed to comply with a requirement of the Regulations in relation to your
request. Representations must be made to us no later than 40 working days
after the date you believe we failed to comply with such a requirement.
