Allocations and Management of Development policy document (SAMDev) for the
Old Hill Fort, Oswestry.

Having looked into your request and considered the files held by English
Heritage with regard to the local development framework, I write to seek
clarification of your request.

Please can you provide me with a date range for the information that you
are interested in. As far as I am currently aware, English Heritage holds
information dated from 2006 to the summer of 2012 that is potentially
relevant to your request.

Please can you also confirm whether you are specifically interested in
SAMDev related correspondence regarding the Old Hill Fort, Oswestry, only?
As I am sure you can appreciate, the SAMDev covers a wide area, of which
the Old Hill Fort is one part.

Mrs Pearson has passed me your email of 17th July requesting an internal
review of her clarification of your request, originally placed on 13th
June, for correspondence relating to the preparation of Shropshire Unitary
Authority's Site Allocations and Management of Development policy.

I have discussed this matter with Mrs Pearson and I apologise on behalf of
English Heritage that, in this case, we did not meet the standards we
normally pride ourselves on and failed to seek clarification from you
earlier and respond within the due 20 days. Whilst it is no excuse, our
Access to Information department has had a very high volume of information
requests in recent months which, I am afraid, has led to a small backlog.
Inevitably the holiday season does not help matters. It took some time for
Mrs Pearson to obtain responses from relevant colleagues and discover how
much information was potentially covered by your request which is why she
asked you for clarification rather later than normal.

Now that the scope of your request has been refined and is clearer Mrs
Pearson is confident she will be able to respond formally on or by 8
August.

Dear PEMBERTON, Ceri,

Thanks you for your prompt and informative reply to my email requesting an internal review. I appreciate that you have fluctuations in your workload, but nether-the-less as you acknowledge in your email the time period for responding to FOI request is set-down in statue, and to my knowledge the CX of your organisation has not informed the relevant Minister that you are unable to meet your statutory obligations.

The date you now propose to reply by is 40 working days after my initial request, twice the statutory period. This is not just unfortunate it has a material impact on the ability of residents in Oswestry, who are concerned regarding development proposals affecting Old Hill Fort, to read you own comments and give them due consideration. Shropshire Unitary Authority has given the public until the 23rd of August for further comments and a reply by the 8th August leaves very little time to arrange meetings in the middle of the holiday season and co-ordinate a response.

I do not want to prolong the correspondence between us therefore I would propose that by way of a compromise if you reply by the 27th of July I will not pursue the matter any further.

I can confirm that English Heritage holds information that falls within
the scope of your request and that, under the Environmental Information
Regulations 2004 (EIR), I am able to provide you with that
information.  Due to the volume of information I am providing to you, I
have split the documentation into two bundles, one of which is attached to
this email, the second of which is to follow in a separate email.

 

I have removed some information from pages 12 and 28 of the
attached documentation, as I believe this information to be exempt from
disclosure under Regulation 13(1) of the Environmental Information
Regulations (EIR). This is because it is third party personal information
and its disclosure would breach one or more of the data protection
principles in the Data Protection Act 1998. I have also removed some
information from pages 1, 2, 3, 26, 27, 28, and 30 as it falls outside of
the scope of your request.

 

Please be aware that the discussions around the possibility of the show
ground being re-located to this area were marked as confidential at the
time they were sent, and although this proposal was then being explored,
it has not been taken forward by Shropshire Unitary Authority, and is not
part of the SAMDev Revised Preferred Options Draft, July 2013, which can
