Firstly can I apologise for the delay in responding to your request.

We are unable to conduct an internal review of our response before we have
provided a response, and therefore would request that you please look at
the information we have provided before considering whether you would like
to follow the appeals process.

 

Response:

Can you please provide copies of all correspondence (written and email)
between yourselves and North Yorkshire county council (NYCC) pertaining to
the inspection?

We have carried out a thorough search of the school’s records and can
confirm that we have attached all correspondence between the school and
NYCC pertaining to the inspection.

Can you also please provide copies of all correspondence (written and
email) between yourselves and Ofsted pertaining to the inspection?

Please find attached all correspondence the school holds between Ofsted
and the school pertaining to the inspection. Please note that some
redactions have been made where information is exempt from disclosure by
virtue of Section 40(2) of the Freedom of Information Act 2000 (amended by
Schedule 19(58) of the Data Protection Act 2018).

 

Section 40 (2) of the Freedom of Information Act 2000 exempts personal
information from disclosure if disclosure would breach one or more data
protection principles specified by Section 5(1) of the General Data
Protection Regulation (GDPR). In this case we consider that disclosure
would breach the first principle, namely that personal information must be
processed lawfully, fairly, and in a transparent manner in relation to the
Data Subject. In this case we consider that the disclosure would be unfair
and none of the conditions for processing, listed in Articles 6 and 9 of
the GDPR, would be met.

 

This exemption is an absolute exemption and therefore not subject to the
Public Interest Test.

Where possible, a description of this information has been given instead.

Please also include notes of any meetings or telephone calls and a list of
any visits to the school by external parties regarding the inspection
(including, but not limited to NYCC staff)

We have attached all records relating to this.  

 

Appeals Process:

If you are dissatisfied with the way in which the school has responded to
your request for information then you may request that the school conducts
a statutory Internal Review. You may wish to request such a review if you:

 

* are dissatisfied with the way in which your request has been handled,

* do not agree with an exemption that has been applied to the
information you have requested,

* believe that not all of the information has been provided to you.

 

Upon receipt the school will review your complaint. The reviewing officer
will then examine your original request and the response that was sent to
you and decide whether the school responded to your request appropriately
according to legislative requirements. The reviewing officer will also
decide whether to uphold or overturn decisions to withhold information.

The school will conduct FOI Internal Reviews within 20 Working Days.

If, following the completion of an internal review, you still remain
dissatisfied with the way in which the school has handled your request
then you may appeal to the Information Commissioner’s Office (ICO). The
ICO is the UK’s Freedom of Information and Data Protection Regulator.
