Officer Member Protocol and Members' Code of Conduct.

Dear Haringey Borough Council,

The local Haringey Association of the National Union Teachers (NUT) has recently published part of a communication it received from a consultant, Ms Jacquie McGeachie, currently working for Haringey Council's Human Resources

According to the NUT Ms McGeachie advised the NUT that "it is inappropriate for Members" [i.e. councillors] "to become involved in the detail of employee related matters ...". And that "Members are bound by protocols and codes of conduct and to involve themselves in" [a particular personnel] "matter could be a breach of the Officer Member Protocol and potential breach of the Members Code of Conduct."

Can you please send me - electronically if possible - copies of the current versions of the two documents referred to:
(1) The Officer Member Protocol;
(2) The Members' Code of Conduct.

In addition:
(3) It would be helpful as well if you could please point me to the relevant sections within the two documents.

If it is more convenient for you, if one or both documents are available and downloadable from Haringey's public website, please supply the links.

Thank you for your request for information received on 10 November 2014,
in which you asked for the following information.  My responses are shown
below. 

 

A - With regard to the Specific case

 

1.    How Ms Cattermole was selected; for example what process of
selection, tendering etc was used.

This matter is covered by the attached Policy for use of Consultants/
Interims

 

2.     (a)  How much Ms Cattermole was paid.

The daily rate that Ms. Cattermole is considered to be personal
information and would not be disclosable.

(b)  Whether she was paid at a daily or hourly rate; or otherwise.

            Ms Cattermole is paid a daily rate 

(c)  Whether Ms Cattermole was paid as a self-employed person; or via a
Personal Service Company; or otherwise. 

Ms. Cattermole’s payment is made to Penna, the Agency from which she was
supplied. Her employment status is a matter between herself and Penna and
the council has no involvement in this.

 

B  - With regard to such cases in General

 

3.    Please supply a copy of any Haringey guidelines applying to the
selection of Independent Investigators.

Please find attached a copy of the Discipline Procedure and the Discipline
Procedure Management Guidelines which cover these issues.

 

4.    A copy of the guidelines regarding the scale of payments made to
Independent Investigators.

There are no such guidelines

 

5.     A copy of the procedures or protocols required to be followed by an
Independent Investigator working for Haringey.

Please see the answer to 3 above.

 

6.    If such procedures or protocols do not exist , then the guidelines 
which Haringey provides to Investigators - for example  in respect of who
should be offered interviews. Also whether an Independent Investigator is
required to follow standard good practice in Haringey regarding: (a) the
sequencing of interviews and (b) whereby during interviews  a verbatim
written record or audio recording is made, followed in the latter case by
transcriptions made available to the persons interviewed, for comment and
correction.

7.    What steps are taken to ensure that Independent Investigators are
indeed independent?
