Officer initiated standards board investigation against Cllr Aspden

We're waiting for Gwen Swinburn to read a recent response and update the status.

Dear City of York Council,
It was announced yesterday in the press that the completely cleared leader of the York Lib Dem group has now taken back his duties as Deputy Leader of City of York Council . https://www.yorkpress.co.uk/news/1748438...

I would like to know the costs in their entirety to date of this farcical standards process. As staffers wrongly chose to intertwine a separate, Officer initiated, even more feeble case against fellow Lib Dem Exec member Cllr Ayre, I am content for all the costs of the two cases to be presented together.

I expect to see all the invoices and accommodation , travel and incidental expenses for all the many lawyers, and experts, staffers used to try and justify their actions in relentlessly pursuing their agenda .

These include but are not limited to initial investigator, Roger Morris, the second round of ‘investigators’ and legal ‘opinion’. Gowling and then the Grimsby lawyers who were also engaged as ‘specialist lawyers’, for reasons yet to be clarified. Also the costs/expenses of the North Yorkshire Monitoring Officer who graciously offered his expertise, I understand at no direct cost to the Council.

There may have been others, if so please include all costs to date.

Yours faithfully,

Gwen Swinburn

Dear Ms Swinburn,

Please see below the response to your enquiry under the Freedom of
Information Act received on 9 March 2019.

I would like to know the costs in their entirety to date and see all
invoices for the Standards Inquiry relating to Cllrs Aspden and Ayre.

The total cost to the council for these matters to date is £98,348.37,
excluding VAT.  The payments are to private solicitors.  There was no cost
for the North Yorkshire Monitoring Officer.  There was also no cost for
advice received from the Local Government Association, as this was covered
by the council’s subscription.

The invoices are attached. Some of the information has been redacted to
comply with data protection law, and therefore has not been disclosed to
you pursuant to Section 40(2) of the Freedom of Information Act because it
would be unfair to the individuals concerned.

Some of the information has been redacted for reasons of confidentiality
and has therefore not been disclosed to you pursuant to Section 41 of the
Freedom of Information Act because it would be a breach of confidence
which would be actionable.

If you are dissatisfied with our response you have the right to ask for a
review of how your enquiry was handled and responded to.   This can be
done by contacting us through [1][City of York Council request email] stating your reason(s)
why you are dissatisfied, and we will pass this to the information
governance team who deal with all reviews of how we have dealt with FOI
enquiries.  If after they complete their investigation and reply to you
with their findings, you still remain dissatisfied you can contact the
Information Commissioner, contact details below:

Dear City of York Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of City of York Council's handling of my FOI request 'Officer initiated standards board investigation against Cllr Aspden'.

Please can you confirm, as it is not clear in your answer if the services of Roger Morris were at nil cost to this authority. Perhaps this was part of the LGA subscription you allude to? Please clarify,

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/o...

I am writing to request an internal review of City of York Council's handling of my FOI request 'Officer initiated standards board investigation against Cllr Aspden'.

Thank you for sending the bare minimum one line invoices. Wilkin refer to an attached schedule for each invoice which you have not provided and Gowling I assume does the same. Can you please provide all the recorded information attached to each invoice, as it cannot be you pay out thousands of pounds on one line invoices.

Thank you

Dear Ms Swinburn

Please see below the outcome of the review into this Freedom of

Firstly, please accept the council’s apologies for the delay in responding
to you.

‘Please can you confirm, as it is not clear in your answer if the services

of the LGA subscription you allude to? Please clarify.’

subscription to the Local Government Association (LGA), therefore there
has been no cost to the council on this matter for advice from the Local
Government Association, as this was covered by the council’s subscription.

Commissioner, contact details below:

Dear [email address],

After your (once again) delayed response, I note that you have only addressed part of my request for internal review. I asked for all recorded information, beyond the one line invoices. If you hold that information you must say and produce or give a reason for refusal. I will given 5 working days before reporting to the ICO.

Yours sincerely,

Gwen Swinburn
