I'm a reporter with Newsquest's Data Investigations Unit and I'm hoping to obtain information relating to the number of police officers and staff arrested between 2015 and 2019 to date.

I'd prefer to receive the information in Excel spreadsheet - xlsx or xls - format and if you cannot provide the information in full, I would like to request that you provide as much as you are able to within the cost and time limits of the Act.

If you need clarification or can suggest ways in which the request can be refined in order for it to be successful, I'd be grateful if you could contact me as soon as possible.

I'd like to know the following, please:

1. The number of police officers arrested between 2015 and 2019, with figures broken down for each year.
2. The number of police staff arrested between 2015 and 2019, with figures broken down for each year.

For each arrest, please provide:

3. a. The rank/role of the arrested person
b. Years in service
c. Date of arrest
d. Details of the offence the individual was arrested on suspicion of
e. The outcome of the criminal investigation, including the outcome of any prosecution where applicable
f. The outcome of any other investigation into the matter - please specify who conducted the investigation (i.e. internal within the force, the IPCC, etc) and the end result of that investigation

Please structure the response for question 3 a-f within an Excel spreadsheet with the columns 'Date of Arrest - Officer or Staff - Rank/Role - Years in Service - Offence - Criminal outcome - Other outcome'.

Thank you for your e mail dated 23 April 2019 in which you made a request
for access to certain information which may be held by Northumbria Police.

 

As you may be aware the purpose of the Act is to allow a general right of
access to information held at the time of a request, by a Public Authority
(including the Police), subject to certain limitations and exemptions.

 

You asked:

1. The number of police officers arrested between 2015 and 2019, with

We have now had the opportunity to fully consider your request and I
provide a response for your attention.

 

Following receipt of your request, searches were conducted only within the
Professional Standards Department of Northumbria Police. Any other
searches would have rendered this request exempt under Section 12 or
burdensome under Section 14 due to additional search areas  which would
have required extensive research being carried out, ie of PNC records.  In
order to provide you with a response we have therefore limited any
searches to the  Professional Standards Department.

To note – Section 40(2) has been applied to some of the information above
where officers have not been dismissed.

Section 40(2) Personal Information:

This is an absolute exemption and therefore a Public Interest Test is not
relevant.  However, for clarity, I will explain my rationale for engaging
this exemption.

Section 40(2) provides that information is exempt if it is the personal
data of someone other than the applicant and disclosure would breach any
of the data protection principles. The term ‘personal data’ means data
that relates to a living individual who can be identified.  This may take
an obvious form of ‘personal’ such as a name but can also include
information from which a person can be identified. Although not explicitly
naming individuals, the cumulative effect of full disclosure may lead to
the identification of those involved

A disclosure in this instance, because it is so specific, would infringe
the first Data Protection Principle, in that it would be both unlawful and
unfair

 

 

Due to the different methods of recording information across 43 forces, a
specific response from one constabulary should not be seen as an
indication of what information could be supplied (within cost) by another.
Systems used for recording these figures are not generic, nor are the
procedures used locally in capturing the data. For this reason responses
between forces may differ, and should not be used for comparative
purposes.

 

The information we have supplied to you is likely to contain intellectual
property rights of Northumbria Police. Your use of the information must be
strictly in accordance with the Copyright Designs and Patents Act 1988 (as
amended) or such other applicable legislation. In particular, you must not
re-use this information for any commercial purpose.

 

You may be interested to know that Northumbria Police routinely publish
