Dear Greater Glasgow NHS Board,

I am writing to request information under the Freedom of Information Act 2000.
I would be interested in any information held by your organisation regarding my request. I understand that I do not have to specify particular files or documents and it is the departments responsibility to provide the information I require. If you need further clarification please contact me by email.

I would like to request the following information:
1. The names and job titles of all 'Office Holders' within your organisation as per HMRC's definition.
2. It will be recognised that Persons with Significant Control information on those who have authority to exercise executive control should be publicly accessible (as per Persons with Significant Control Regulations 2016) but, in the unlikely event that an attempt is made to cite the Data Protection Act 1998 to refuse the disclosure of the names, I would request the job titles of these individuals be disclosed without their names and I will reserve the right to appeal to the ICO for the rest of the information requested.
3. A copy of the relevant sections of the deed of trust, or memorandum and articles of association or equivalent document under which these office holder's offices are created - just the relevant clauses or articles will be sufficient.
4. As Office Holders are not necessarily also employees could you confirm if a contract of employment exists for each of the job titles.
5. I was doing the Locum as a Consultant Physician at Inverclyde Royal Hospital between 24.08.15 – 28.08.15. Could you confirm please my post was an “Office Holder” or not.

I would like the information to be provided by email or on this website in electronic form.
If my request is denied in whole or in part I ask that you justify all deletions by reference to specific exemptions of the act. I will also expect you to release all non-exempt material. I reserve the right to appeal your decision to withhold any information or to charge excessive fees.
I would be grateful if you could confirm in writing that you have received this request. I look forward to your response within 20 working days as outlined by the statute. Many thanks for your assistance with this request.

Thank you for your request received on 28 August 2017 for the provision of
information relating to Office Holders.

 

We are treating your request under our procedures for responding to
requests for information under the Freedom of Information (Scotland) Act
2002.

 

I can confirm that NHS Greater Glasgow and Clyde (NHSGGC) holds the
information as described by you.

 

Below are the  questions you asked and NHSGGC’s response in italics and
bold.

 

1.      The names and job titles of all 'Office Holders' within your
organisation as per HMRC's definition.

          [NHSGGC office holders are the Non Executive Members of the NHS
Board.  This information is publically available on the NHSGGC website at

          The only exceptions in this link are the undernoted who are the
Chief Executive and four Directors as indicated below:-

 

          Ms Jane Grant, Chief Executive

          Dr Jennifer Armstrong, Medical Director

          Dr Margaret McGuire, Nursing Director

          Mr Mark White, Director of Finance

Dr Linda de Caestecker, Director of Public Health.

      

          Each Non-executive member is appointed by the Cabinet Secretary
for Health & Sport].

 

2.      It will be recognised that Persons with Significant Control

(Scotland) Act 1972].

 

4.      As Office Holders are not necessarily also employees could you
confirm if a contract of employment exists for each of the job titles.

          [A letter of appointment is provided to each Non-executive
member by the Cabinet Secretary].

 

5.      I was doing the Locum as a Consultant Physician at Inverclyde
Royal Hospital between 24.08.15 – 28.08.15. Could you confirm please my
post was an “Office Holder” or not.

          [Locum Consultants are not office holders, therefore, your post
was not an office holder].

 

I hope this information is helpful.  If you are not satisfied with our
response to your request, you have a right to request a review of this
decision within 40 working days of receiving this response.  The procedure
for consideration of a review is detailed in the attached note.  The note
also describes your right to pursue the matter with the Scottish
Information Commissioner if, following a request for review, you remain
dissatisfied with the decision of NHS Greater Glasgow and Clyde.  If
following appeal to the Scottish Information Commissioner you still remain
dissatisfied with the outcome, you have a right of appeal to the Court of
Session on a point of law against the decision of the Scottish Information
Commissioner.
