Dear Mr Smyth,
I am contacting you because the time limit for responding to your request
for information needs to be extended.
It is occasionally necessary to extend the 20 working day time limit for
issuing a response. In this case, this is because the information
requested is being considered under one of the exemptions to which a
public interest test applies.
The exemption concerned is section 36 of the Freedom of Information Act,
which deals with the exemption of information that would prejudice the
effective conduct of public affairs. This extra time is needed in order to
decide whether the public interest is in favour of releasing the
information or not. I will contact you by 14 June 2022.
Kind regards
Gloria Akinyemi

Dear Office of Communications,
Please pass this on to the person who conducts Freedom of Information reviews.
I am writing to request an internal review of Office of Communications's handling of my FOI request 'Ofcom Process Document - For When a complaint is formally received about wireless interference'.
I note that you have not confirmed or denied whether the authority holds this information, and have not applied an exemption that would remove this obligation.
As you may be aware, Section 1(1) of the FOI Act (https://www.legislation.gov.uk/ukpga/200...) states that "Any person making a request for information to a public authority is entitled to be informed in writing by the public authority whether it holds information of the description specified in the request".
I would be grateful if you could clarify whether or not this information is held, or specify which exemption of the duty to confirm or deny you are applying.
I specifically asked this:
I refer to your website page
https://www.ofcom.org.uk/complaints/comp... Please could you provide a copy of your internal documented process (Document) for when a complaint is received about wireless interference for: 1. Interference to wireless devices at home 2. Interference to Amateur Radio 3. Interference to Business Radio 4. Interference to Hobby Radio 5. Illegal Broadcasting (Pirates)For each case, please document from initial complaint received to resolution. Please include the ability to give feedback and challenge.
Ofcom's brief response was that they are applying an exemption for this reason:
"its disclosure may prejudice the effective exercise of our functions to determine if a person has failed to comply with the law or if circumstances exist which would justify regulatory action in relation to cases of suspected interference"
My question was not solely about "A person" , but could also be a Business (Large or small).
As a public service from Ofcom; How can Ofcom as a public service body and it's processes (This specifically) be audited to an acceptable standard for the UK, when it is kept an internal secret. and may be out of date and possibley not be documented or applied to a standard.
A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/o...
Yours faithfully,
Martin Smyth
