In the report, "Continuous Cruiser Project May to October 2011: Results into work undertaken on non-compliance of British Waterways Continuous Cruiser regulations on the South Oxford Canal, 30 March 2012," that you sent me in reply to freedom of Information request the report:

"Final Report into non-compliance of British Waterways Continuous Cruiser regulations on the South Oxford Canal" is mentioned, and that it contains "full details of this project including the initial analysis, methodology and conclusions". It was submitted in October 2011 also by Lisa Jarvis. Please send me the October 2011 report.

I am writing to request an internal review of Canal & River Trust's handling of my FOI request 'October 2011 report by Lisa Jarvis'.

I'm sorry but you are mistaken. On page 2 of the report you sent me twice, "Continuous Cruiser Project May to October 2011 : Results into work undertaken on non-compliance of British Waterways Continuous Cruiser regulations on the South Oxford Canal"

it says:

"Please refer to the “Final Report into non-compliance of British Waterways Continuous Cruiser regulations on the South Oxford Canal” for full details of this project including the initial analysis, methodology and conclusions, submitted October 2011. Below is a brief extract: "

The report you sent me covers these headings:

1. A brief summary of project

2. Results

3. Conclusions

Final Observations

Final Conclusions

It does not include initial analysis, methodology and full conclusions. So it is a different report. It is clear from reading it that the report you sent is a brief extract from the report of October 2011. Please send the report of October 2011 thatI requested in my original request on July 6th.

You were indeed correct and I have now managed to (finally) locate a copy of the document you have requested following some protracted correspondence with my colleagues in our enforcement team. Please accept my sincere apologies for this omission, it was a genuine error.

Please note that personal information has been removed for this report as it is protected by the Data Protection Act 1998. As such the information is exempt from disclosure under section 40 of the Freedom of Information Act.

Please note that the previous information has been removed from this site upon our request. We were informed today that the personal information redacted from document ' Continuous Cruiser Project May to October 2011 Final Report March 2012' still displayed in some circumstances.

Unfortunately, Whatdotheyknow.com were unable to simply replace this document with the attached version and so they have had to remove the entire thread of correspondence.

I am writing further to my earlier e-mail today as I have now had the opportunity to speak to relevant colleagues about this.

The document sent in response to your earlier request (also attached for you now) is the document you refer to below. It was finalised in March 2012 not October 2011 so this explains the date on the first page of the report. Lisa Jarvis has not written any other reports on this matter.

If we haven’t reasonably met your expectations in relation to a request for information or you believe we may not have acted in accordance with the above legislation you should write in the first instance to Kelly Radley Head of Customer Relations, 64 Clarendon Road, Watford, Herts WD17 1DA outlining your concerns and asking for a review to be undertaken. Your correspondence will be acknowledged and a review of your case will be undertaken by one of British Waterways’ directors or managers in a senior role.
